Federal judge rejects Dakota Access Pipeline permits, calls for do-over

In a dramatic turnaround, a federal judge has ruled that permits to complete the Dakota Access Pipeline must be reconsidered, and the Standing Rock Sioux Tribe has demanded the flow of oil through the pipeline be stopped.

The tribe argued the pipeline, routed within a half mile of its reservation, puts its water supply in the Missouri River and tribal lands, including sacred sites, unduly at risk.


So it doesn't actually go through their reservation.

Am I reading this correctly? these permits have already been approved? The discussion period has been allowed and completed environmental impact study has been completed? How then can someone come in and say they want a do over? Where were these people when the process to complete the pipeline was ongoing?

There’s more to it than that. There are legal protections against these things. It’s estoppel + a bit of ex post facto. Restraining orders are upheld when the outcome of the cause is in doubt. They’re lifted when the outcome is likely in the government’s favor.

That its taken so long and so late to question the lifting of the restraining order tells me this is fishy on the face of it. Perhaps they found a Judge with TDS.

So the tribe is claiming ancestor and cultural hunting and fishing rights on a man made reservoir? Take the dam down.

Yes, the oil is being pumped. The pipeline was completed by April and first oil was delivered on May 14, 2017:

The pipeline also crosses the Missouri in western ND.

In principle, it can never be stopped. Outcome oriented jurisprudence runs from common to uncommon, depending on many factors. I do agree that at this point, the institution deserves no respect. It has no moral authority, and is basically a gang of thugs who are skilled at composing nonsense using dense legal jargon.

The usual corrective mechanism of impeachment is inoperative due to Congressional aversion to accountability. The corrective mechanism in place has a time constant (engineering term for speed of process control loop) of 40 years or so, and consists of retirement and death on one side, and nominations and appointments on the other side.

It is way past the time when some of these liberals should be impeached and removed from office. That would be a great first step at getting the judiciary to restrain its activism.
