Did Comey Violate Laws In Leaking The Trump Memo?

One of the most interesting new disclosures today in the Comey hearing was the admission by former FBI Director James Comey that he intentionally used a “friend” on the Columbia law faculty to leak his memos to the media.  Comey says that he did so to force the appointment of a Special Counsel. However, those memos could be viewed as a government record and potential evidence in a criminal investigation.

Comey perjured himself here as well.

He said the memos were leaked in response to the tapes tweet.

The tapes tweet came out a day after the memo leak.

Comey has politicized and tainted the once respected FBI. It will be hard for people to ever see the agency as trustworthy and competent again thanks to him. Some legacy.

Comey’s notes are “work product”, taken in the course of his official duties.

Correct. He wrote the memo while employed by the American taxpayer. Those notes were not his to leak.

Based on your comment, you probably know that what Comey leaked is considered, at a minimum, Sensitive But Unclassified (SBU) information that requires strict controls over its distribution. All federal employees who handle sensitive and classified information receive training on their responsibilities on how to handle and safeguard such information. They know well that there are penalties for violating this trust. Comey clearly knew he was violating the law.

I am with you. Sessions needs to go, the sooner, the better. Initially, I had high hopes for him, then the Democrats neutered him early and easily. He is not up to the job.

Glad you caught this timeline. And not a single Republican senator asked Comey how he knew about the “tapes tweet” before he leaked his memo. The chronology is askew and points to Comey’s delusions of grandeur.

His statement that the leak would trigger a special counsel is bogus. Why would Comey want to trigger a special counsel, after previously swearing three separate times that President Trump was in no way personally under investigation.

Yes! He probably also typed the notes on a government-issued laptop, while sitting in a car which likely belonged to the government. His notes are federal property that did not belong to him.

If his laptop belonged to the Feds, and he returned it when he was fired, how is that he still has a copy of the notes? He must either have printed them out, or, more likely emailed or transferred them to his own computer at home. Then he emailed them to his Columbia friend and asked him to give the memo to the NYT. Besides the notes being the property of the US Government, if he didn’t consider his notes to be “classified”, he certainly must have considered them to be “sensitive”. It sure seems to me that every action he took in this chain of events was illegal.

But, just as you said, nothing will be done.
