I’ve said this on FR many times. This treaty was never ratified by the US Senate and therefore has never been in legal force for the USA.

All right. Although, I haven't seen it in these words that any or all treaties can be "unilaterally withdrawn by the president" which is more blunt and to the point.

Moving on, the media is now blabbering about Trump being partially in with qualifications. If it's something like we get same deal as China and India being exempt until 2030 ...I'll have to mull that one over. I guess we will find out within 1 hour.

I heard yesterday on Fox News that 20+ senators, including McConnell, sent the President a letter, urging him to reject this Paris treaty.

I was very encouraged to hear that and hope that the President will regard the wishes of his base and those in Congress who oppose this globalist money-grab.

Once a treaty has been ratified by the Senate, a president can still withdraw unilaterally I believe, although the US Constitution says nothing on the matter of withdrawing from treaties. There was a lawsuit brought by Senator Goldwater in 1979 over President Carter withdrawing from the mutual defense treaty with Taiwan. The Supreme Court declined to decide the case, saying it was a political matter between the POTUS and Congress.... which left Carter’s action standing. There was a lawsuit filed after President Bush withdrew from the ABM treaty with Russia (which really had been a treaty with the USSR), but I can’t seem to find out online whether that was ever resolved. I imagine if the SCOTUS had actually heard and decided the case it would be easy to find on the web, so it may be that they left Bush’s action to stand in that case, too.

This was covered by Rush yesterday in detail.

It’s not a treaty it’s an accord. An agreement on common goals and intent. But because of the Treaty of Treaties it is supposed to be followed just as if it was a treaty once Obama signed it. However, the Treaty of Treaties has never been ratified either. So The Paris Accord is essentially a BS-layer cake which lawyers will attempt to bully the US into following unless Trump publicly states his intention to not abide and to withdraw Obama’s signature. At that point the member nations of the Accord and climate-scam lawyers have no grounds to penalize or sue the US.

Relax. If Trump were going to stay in, he wouldn’t be drawing this out. Trump is performing slide of hand on a much bigger scale. Everyone look here while I do something over there. And when he drops the bomb on the Paris Accord, I suspect that he will also be dropping a bomb somewhere else, like leakers.

It's out there I saw it the other day. I believe I read in a summary excerpt of the article that a lower court threw out or the administration won the case on the merits.

If she is persuaded withdrawl is what wins votes in Michigan and Pennsylvania (and never EVER forget, they matter, you don’t) then she will recommend withdrawl.

And, again, it is illegal, either in EO form, or in Senate ratification form, because it is unconstitutional, and, therefore, null, void, and unenforceable regardless of what Trump does. Of course I hope he rejects the Paris Accord, but we are a nation ruled by law (the Constitution) not man. Trump is NOT the final word if what he says & does creates an unconstitutional treaty.

Really, what does he have to lose? It’s an economic drag, the economy is where his base and the new voters want him to go. The side of socialism, which hates this move, already burns with white-hot hatred of his very existence...they can’t hate him more. This is a rather simple political calculation for him. The nominal half that hate him just have one more thing to put in their dumb-ass chants. Otherwise, no down side at all.
