HEY STUPID PEOPLE
THE AIRLINES SOMETIMES *NEED* TO MOVE A PILOT AND CREW
STOP PLAYING LAWYER
THEY HAVE EVERY “LEGAL RIGHT” TO REMOVE ANYONE FROM AN AIRPLANE FOR ANY REASON_ EVEN IF THE PILOT JUST DOES NOT LIKE THEM
The issue is corporate arrogance and elitism. They treated their paying customer as a slave who had no rights or dignity. Keep in mind when Rosa Parks was asked to leave her seat on the bus, she was offered another one. That started a movement. This is even worse.
It's about time people stood up to corporate thuggery. There used to be rules to protect consumer rights. There used to be rules to protect us from out-of-control monopolies. Are those rules still on the books?
OK THEN, MAYBE YOU WILL READ AND UNDERSTAND WORDS FROM A REAL LAWYER..
(Sorry everyone else, apparently one must shout to get this poster's attention..)
United Airlines' Own Contract Denied it any Right to Remove Passenger
(Jens David Ohlin - Associate Dean for Academic Affairs and Professor of Law, Cornell Law School, 218 Myron Taylor Hall, Ithaca, NY 14853-4901, Phone: (607) 255-0479, Fax: (607) 255-7193, Email: jdo43@cornell.edu)
Not according to the ticket contract, according to the article. It says there are a defined list of reasons a passenger with a reserved, confirmed seat may be denied service, and because they prefer to give those seats to employees is not one of the reasons.
The airlines, in the fine print of you ticket notifies you that what you have is in essence a contract, with terms and conditions.
United’s entire terms of service spells it out. It spells out what United is allowed to do by it’s own contract.
It is allowed to involuntarily not board passengers for a variety of reasons, including over booking. It did not refuse to board the passenger for any reason.
It is allowed, by its own contract, to involuntarily remove a passenger who has been boarded. To resolve a need for a seat for someone else is not one of them. They may ask for volunteers. That’s it.
STOP PLAYING LAWYER
Not only did I win, but the judge threatened her lawyer with contempt TWICE in her efforts to get me to “act out” in court. Which I didn’t. But she did.
Law is not rocket science. You just have to understand legalese and parse sentences very carefully.
I thought we FReepers tended to be libertarian-types and supported the right of businesses to serve or not serve their customers.
But I guess that goes out the window and we become FLAMING LIBERALS when:
1) We don’t like the company
2) There is a video
3) The media whips us into a frenzy
So much for us FReepers ‘standing on principle’, at least in this case.
ALL CAPS is just plain stupid. Get over yourself.
come on man give it up. the all caps all the time crap on this one topic is getting old. How about we simma down now and discuss this rationally or... well never mind:(
Hopefully not while it's in the air.
Just for starts, the pilot was completely uninvolved because the aircraft was on the ground. This was all the action of the ground crew.
Both the Federal law under which the airlines operate and the Contract of Carriage are legally binding and do matter.
The airlines and their employees are NOT some kind of sovereign country and free to do just as they please.
His assault lawsuit will trump "legal right."
Contract Carriage rules signed by Hague Conventions under ICAO Statues for air flights... read them shitheel... They cannot remove you involuntarily for any reason... with compensation... Dr. Doa was never offered any compensation nor accepted it.
Gate Agents own the passengers till the beacon is turned on and door closed
Gate Agent is going to jail as are the Airport Police....
Hey, stupid airline with the stuck caps lock, no sensible passenger will ever buy a ticket in the knowledge they can be forcefully tossed off the plane just because you feel like it.
I don’t gives a rat’s behind what your excuse or “legal right” is. If you can’t manage a transport business any better than that you deserve to go out of business.
It is also more than a little disturbing how some people get off on an authority fetish. Brute force is an ugly thing.
The optics are so bad on this one it doesn’t matter what the law is or isn’t. The damage has already been done and the poor PR and press stories will continue unless United settles this one fast.
The verdict, on behalf of Dr. Dao, for a $100,000,000 million dollar settlement would be in in less than 5 minutes.
