Souter never had the slightest history of being a conservative and was only chosen because he was a long time friend of he Bush family and "acceptable" to democrats and RINO Republicans. He was picked as a consensus candidate because GHW Bush didn't want another contentious Bork nomination like Reagan had. Bush never for a minute thought Souter was a Scalia conservative, he kind of hoped he Souter would be a O'Connor/Kennedy moderate, but even that turned out to be optimistic.
Gorsuch, on the other hand, is considered by every legal scholar as a model of conservative legal thought. Yes, you can cherry pick a couple rulings (out of hundreds) where he might appear more moderate. But even Scalia himself thought highly of Gorsuch. At the absolute worst Gorsuch might end up more like a Roberts, but not Souter.

He was right to defer to the Supreme Court. He was also right to note the need for the Supreme Court to re-examine the Chevron ruling, which he believed forced his deference. He did not interpret the federal law, but deferred to the executive branch, and complained that he had to.
I just don’t like that he’s starting to come off insincere. For now, it’s towards the Democrats. But if it weren’t for Prof. Robert George’s defense of him, I’d be very wary of a Judge Souter. And I’m wary of relying on another, no matter how great that other is.

I feel uneasy about Gorsuch also. Something about him doesn’t ring true to me.
Laura Ingraham yesterday pointed to several more Conservative leaning Judges who may be in consideration next time around. We’ll see. Gorsuch will certainly have time to rule on a few cases before there’s another seat to fill.

Me too- Yesterday he said that gay marriage is “Absolutely Settled Law” (Even though no cases have come up challenging it in the SC) while calling roe vs wade simply ‘settled law’ because ‘it has been challenged over and over and is now settled law’
Scalia Replacement? Scalia argued against Gay Marriage- Stating that centuries of traditional marriage all around the world and custom should Have weighing when deciding the case- (He of course put it much more betterer than I- but that was kinda the crux of his argument/dissent)
What is Gorsuch’s stand on climate change? Is he in favor of that too?
...and in the meantime, if Gorsuch turns out to be a Sandra Day O'Connor type judge, it will move the Supreme Court significantly to the left since he's replacing Scalia. He will then have a lifetime tenure on the court and we'll be stuck with him for decades, and unable to undo the damage.
Amazingly, a bunch of FReepers want to rubber stamp this guy ASAP and say the only downside to his nomination is that he "hasn't been confirmed yet".

Gorsuch attends the most liberal Episcopalian church in Boulder (with a rabid left-wing activist female "priest" as the pastor), clerked for Kennedy, and made it trendy to use female pronounces like "she" and "her" to refer to men who "feel" female.

Tsk, tsk. Shame on you for actually examining the judge's record and statements and looking at it objectively. A bunch of FReepers have informed us that the ONLY downside to the nomination is he "hasn't been confirmed yet" and the Senate Republicans should blindly trust the nomination and rubber stamp him to a lifetime tenure on the nation's highest court immediately.
You mean that strategy didn't magically produce awesome results when GOP Presidents appointed so-called "strict constuctionists" like Warren Burger, Harry Blackmun, John Paul Stevens, Sandra Day O'Connor, David Souter, and John Roberts?

I do not suggest that I understand what the Judge had to say on the oxymoron of same-sex marriage. I did not hear the comment, or know how he justified it, if he went that far. Hopefully, if a relevant case comes before the Court, he will listen to the arguments, and change his opinion--if it has been correctly reported.

Exactly- He apparently won’t use the words ‘illegal alien’ either- evidently preferring to call them ‘immigrants’
