MIAMI (CBSMiami) A Miami-Dade judge ruled Friday that county holds of arrested immigrants for ICE is unconstitutional but the debate is not over.
Yeah, this is a great win. Its a great win for the Constitution. Its a great win for individual rights and its a judge whos courageous enough not to be intimidated by the president of the United States, said attorney Louis Reizenstein.
In his order, the judge said the ICE holds on county inmates violate the separation of powers between the state and federal governments (and) the Constitution of the United States .The Federal government is without power to compel state authorities to house Federal prisoners.
While the judge ruled against the county, the practical effect of the ruling on arrested immigrants is not yet clear since the county can appeal the decision and they plan to.

Local police and sheriffs hold people for the feds all the time, not just illegal aliens.
To Miami-Dade judge: harboring, sheltering, and aiding known illegal aliens is a FEDERAL FELONY, from which you are NOT immune. That means that every single illegal you let walk just adds to your prison sentence.
This sounds like a Judge with a major judicial godhead complex and needs to be slapped down very hard.

The problem is, thus far they have been immune. I will believe that they are not immune when I see them being arrested.
This is what makes the 9th circus ruling so dangerous. By one interpretation it gives standing to ANYONE who wants to enter the country. That’s why the 9th has refused to stand down on suspending the original EO so they can set precedent. With a 4-4 SC almost anything could happen.

The answer to this problem = ICE gets a warrant to hold illegals in jail until ICE arrives.
Immigration and illegal immigration are under Federal law, not the states.
If it were state law and NY decided it wanted to take in known elements of radical Sharia loving Islam into their own state, not only their state suffer these consequences.
As Radical Islamist from NY would cross state lines and be supposedly accepted in another state bypassing “that” other state’s rights. In doing that they are tainting another state’s rights to their own right to the”rule of law”.
At some point the Feds should look into arresting some of these Governors or maybe even dethrone Judges who break the known Federal laws on the bench.
Once a Judge shows massive dysfunction, why should they be allowed to stay on the bench. Should be like a Doctor’s oath, DO NO HARM!

It’s no more unconstitutional than Miami-Dade holding anyone whom is otherwise set for release, but is detained at the request of any other jurisdiction for anything else.
