4th Circuit: ‘Assault Weapons’ Can Be Banned for Resembling Military Guns

It is interesting to note that the 4th Circuits ruling comes in the wake of a white paper in which ATF Associate Deputy Director Ronald Turk argued against ongoing importation bans on assault weapons. Turk argued on the grounds that such weapons are increasingly popular for sport shooting and are actually standard for hunting activities. The Washington Post published the paper in which Turk said continued opposition to the weapons is based on an almost 20-year-old study.
But the 4th Circuit described the sporting and hunting rifles as exceptionally lethal weapons of war.

'Moron' the subject. "exceptionally lethal weapons of war." Therein lies one of the many problems. If we could convince the 4th circus that these firearms are just your normal everyday "regularly lethal" labeled instead of "exceptionally lethal" kind, they might change their collective 12 neurons to a positive outcome. Or not. Prolly not.

I think their real definition for weapons of war includes any semi-automatic weapon, not just “assult rifles”.

Exceptionally lethal weapons of war are Nuclear Bombs, guided missiles and poison gases. Most of the rest are derivatives of stuff you can find at the fireworks stand around the end of June.

Not my area of expertise, but I think the 1934 Firearms Act outlawed certain weapons specifically because they were not used by the military. I believe the “sawed off shotgun” was in this category. There was a court case later in the 30s which should have pointed out that sawed off shotguns had been used WW1 trench fighting and had definite military application and, for that reason, should have been declared legal. But the court case was bungled and the law stood.
My limited knowledge of this comes from “Unintended Consequences” by John Ross and my memory may be faulty.
But at one point, I believe that being (or resembling) a military gun was the reason NOT to ban it. Oh how times change.

Not something a soldier would use, but for personal use.

I think their real definition for weapons of war includes any semi-automatic weapon, not just assault rifles. You are wrong. They want them all just like in England. In fact in England you can not have an unlicensed air rifle with over 12 foot pounds of energy. For comparison a 22LR has about 100 foot pounds of energy.
