U.S. President Donald Trump is expected to sign a measure as early as Tuesday aimed at rescinding a major Obama administration water regulation and direct an end to the government's defense of the rule, a Trump official briefed on the plan said late Friday.
Trump is expected to direct the Environmental Protection Agency to withdraw the Waters of the United States (WOTUS) rule, which expands the number of waterways that are federally protected under the Clean Water Act.
The rule was finalized by the EPA and the U.S. Army Corps of Engineers in May 2015, and was blocked by a federal appeals court pending further court challenges.

Which judge is primed to pounce and override him?
Does that mean they’re gonna cancel that 1000 dollar a day fine for the unauthorized pond that formed in my backyard after that last deluge ??
WHATEVER HAPPENED TO TRUMP’S (almost patented) ELEMENT OF SURPRISE !?!
And a Malaysia paper reporting it.... is this a leak?
Terrible law, Trump has talked for months about getting rid of it, so it’s good to see action so early on.
Exactly the kind of question that came to my mind too. Is it okay if I collect water in a cistern for my garden now?
I wonder if the Mass tax on rainwater was tied to this.
Building/construction permits are gonna go through the ROOF. And at least 1000 EPA jobs created with this travesty act should disappear instantly.
Cleaning up the act would be amazing! The EPA has old dry washes, small creeks navigable...they may only run for summer rains if at all and that has to be an considerable amount of rain.
Horrible law. Will the foolish charges brought against “violators” be withdarwn when the “rule” is reversed? A rule that can ruin you for improving a drainage ditch, plowing a field, building a pond or just about anything some pimply faced kid thinks is a violation.
No, you were a violator and must pay the price. Now you are no longer a violator. The feds will never stop coming after a penalty unless Trump issues another order about those.
Looks like mud puddles will no longer be considered waterways!
What WOTUS did. Ephemeral and Intermittent streams:
I can see no reason why they couldn't regulate your bladder as a navigable waterway if you catch raindrops on your tongue.
As with nearly EVERYTHING else, Trump needs to get CONGRESS to make these changes LAW and prevent the next Democratic president from undoing everything!
Not so sure about that.
When a regulation is quashed by the CRA it is made void by cutting off funds for enforcement. That would presumably include past violations.
Definitely.
Yeah, the retroactiveness of it all: if you had building permits shot down because of the pending changes, once they’re CRA’ed out of existence, does your permit get priority? And the new employees zero added for WOTUS are likely the ones he weaponized with the excuse they’d be out in the bushes inspecting dry creeks and needed rattlesnake protection or something. I guess they can be transferred to Point Barrow to count bears.
“Does that mean theyre gonna cancel that 1000 dollar a day fine for the unauthorized pond that formed in my backyard after that last deluge ??”
Here’s your solution:
the 1876 Holman Rule. The rule allows individual members of Congress to target specific federal workers for firing or salary reduction and/or individual government offices for reduction or elimination.
Individual fascist bureaucrats can be targeted, especially if they’re engaged in illegal or capricious activities.
The other ammo you have in your arsenal is the Data Quality Act. This allows anyone to challenge the scientific validity of any bureaucrat rule.
Damn right this should be rolled back. I sat with some of these environmentalist while they spewed their hate. The fact that the property was a peach orchard for 100 years didn’t matter to them. To them, it was a wetland...since the beginning of time. They were totally nuts and prevented the owner from using the land.........period...or take a fine at $12,000 a day.
