When a regulation is quashed by the CRA it is made void by cutting off funds for enforcement. That would presumably include past violations.
Yeah, the retroactiveness of it all: if you had building permits shot down because of the pending changes, once they’re CRA’ed out of existence, does your permit get priority? And the new employees zero added for WOTUS are likely the ones he weaponized with the excuse they’d be out in the bushes inspecting dry creeks and needed rattlesnake protection or something. I guess they can be transferred to Point Barrow to count bears.
I’m not disagreeing, I’m just saying what the bureaucracy will say. It’s not like the prior rule was struck down as unlawful, just that a new President has a different policy position.
