U.S. President Donald Trump is expected to sign a measure as early as Tuesday aimed at rescinding a major Obama administration water regulation and direct an end to the government's defense of the rule, a Trump official briefed on the plan said late Friday.

Trump is expected to direct the Environmental Protection Agency to withdraw the Waters of the United States (WOTUS) rule, which expands the number of waterways that are federally protected under the Clean Water Act.

The rule was finalized by the EPA and the U.S. Army Corps of Engineers in May 2015, and was blocked by a federal appeals court pending further court challenges.

One of the problems was man-made drainage ditches running through properties. The criteria went from "navigable" to every drop I see and if they added soils to the criteria.

Believe it or not, they were discussing what was navigable "in fact" during the first developments near Bufffalo.

Agreed 1000%

Trump has the opportunity and responsibility to undo the excesses of the Imperial Presidency and return powers to Congress where it belongs.

The last thing we need in 8 years is a Democrat President undoing all the good works of Trump via the tyranny of ‘I got a phone & a pen’

Dairy farmers and ranchers were smashed by this act, too.

I guess OFA saved the big bucks for protesting this imperative CRA. Beating the Left was like climbing Mt. Everest only to find billions of fire ants at the top. Can’t sit down to enjoy the victory view until you spend another climbs’ worth of energy killing the ants.

This is good news. Will all the unfortunate people that lost their property and life savings because they had mud puddles or a small pond on their property be compensated?

Maybe, unless you live in Oregon.

Those environmentalists should be fined accordingly.

Years ago, I worked for a company in Dublin, CA that ran a small dielectric press which used a few gallons of cooling water. One day the Coast Guard showed up. They needed us to obtain a permit “for discharging water into a navigable waterway.” We were putting the clean water into a creek behind the building that ran dry in the summer. But somehow that creek was connected to the Niles River, which ran into San Francisco Bay. One of the other engineers remarked that he wondered how they got to our facility since he didn’t see their cutter parked out back!

IMO ... I think "yes"

During the campaign (though no one remembers it as such and folks seem to have forgotten ... ) Trump said, about the gangs in the inner cities that, "The cops know who you are ..." (or who they are) and I interpretted THAT statement to be the signal, "Elect me and I'll let you do your job.

They did and they are now doing their job(s)

Now, to the EPA LMNOP question .....

It seems the only reactions to Trump has been "announcements" of refusal (The NYC chief that says the cops can ignore Trump's immigration orders, f'rinstance.)

IMO, I'd just go ahead and fill that cistern ... The good guys have always been on your (our) side but hampered by the power strokers.

I think all he has to do is choose to cancel it and thats it. its not a law, he can choose not to defend the rule.

They’re trying to get Bumble Bees listed as an endangered species. It’s just another power grab like this was. Of course, bees go everywhere! ...and also, of course, anybody not for the law wants all the bees to die!!!!!!!!!

These people are just power hungry fascists.

I’m not disagreeing, I’m just saying what the bureaucracy will say. It’s not like the prior rule was struck down as unlawful, just that a new President has a different policy position.

Thank God. This was a massive power grab. Massive, costly, and stifling. Great start. Now cut back the previous level of waterways considered “navigable waters” or under EPA jurisdiction. Do it, Mr. President. Cut it way back.

It is an EPA regulation based on a ridiculous interpretation of the Clean Water Act. A judge can’t control how EPA interprets their own regulations unless they completely violate the Clean Water Act. This is not going to be subject to lawsuit.
