(AP) RALEIGH, N.C. -- Lawyers for Army Sgt. Bowe Bergdahl will try Monday to convince a judge that he cannot get a fair trial on charges of desertion and misbehavior before the enemy because of highly charged statements made by President Trump.
The pretrial hearing before a military judge at Fort Bragg is expected to focus on statements Mr. Trump made during the presidential campaign.
Bergdahl is scheduled for trial in April and could face a life sentence if convicted of misbehavior before the enemy. He is accused of endangering the lives of soldiers who searched for him after he walked off his post in Afghanistan in 2009.

Trump’s actions one way or the other have no bearing on the guilt or innocence to the acts that necessitated UCMJ action. He may have some purview over the verdict, but nothing more, really. The little sh!t is guilty of desertion and treason. He needs to face his deeds.

Any comments Trump may have made were gleaned from what every intelligent person in this country was thinking and saying. Were this a civil trial the jury pool would consist of these very same people, not Presidents. If anything military jurists are likely to be more biased against a deserter.
The statements were not made by Pres Trump. They were made by private citizen Trump.
In fact, even if another officer not in Bergdahl’s chain of command made a derogatory comment, that would not constitute unlawful command influence. It would have to take someone in his chain of command for UCI to hold. President Trump is now in his chain of command. What the President says makes a difference. But anything a private citizen said must take a backseat to what the man now in the commander-in-chief seat says.

Also this; when one chooses to commit the high crime of desertion in a war zone, it is big news, and anyone with a smart phone will know about it. There is no suitable juror who has not heard of the case, and of opinions about it.
And more to your point, when Mister Obama made his comments, he was (cough, cough) CIC! And, when Donald Trump opined on the topic, he was a private citizen. Big diff, n'est ce pas?
