Well destroy his career, President Donald Trump said of a Texas legislator who has reportedly introduced legislation to curtail civil asset forfeiture the practice of taking a persons property allegedly used in the commission of a crime unless the individual is convicted of a crime.
Trump made his remarks, which were taken as joke, at a February 7 White House meeting with sheriffs from across the country (shown). But even if the remark was not taken seriously by the sheriffs, who laughed at the threat, it is clearly indicative of the presidents position on the issue.
During the meeting with the sheriffs, the issue of civil asset forfeiture (CAF) was discussed at some length. Sheriff Aubrey of Jefferson County, Kentucky, raised the issue: The other thing is asset forfeiture. People want to say were taking money and without due process. Thats not true. We take money from dope dealers.
Trump then asked, And youre not allowed to do it now?

Asset Forfeiture without a criminal conviction is an abomination.
I agree. It should be done away with. Yes, Trump needs a full briefing on it.
I agree. If someone is arrested and his car is confiscated and held after acquittal, that person should get his car back because he was found innocent.
It just seems to me that ill gotten gains should not be passed on as and estate. Maybe I'm wrong.

You misunderstood what I meant. Seizure of these things to be used in evidence is fine and necessary. What I was talking about was the seizure of cars, cash, and other property, after which no charges are filed and the “suspect” still has to fight to get his belongings returned. I recall very well a case in my town thirty-some years ago where the police chief drove a new Thunderbird that had belonged to an alleged drug dealer who, after having surrendered said car to the cops, had all charges dropped and left town.
That's the point where I want to see the law come down on LEOs who abuse their power.
I expect President Trump to disappoint us on a few issues. Him being a populist, though, I’m surprised it is this one.
