Vanity: Can the president ignore the court and continue with his valid executive order?

Vanity Discussion Question: Can the president ignore the court order and continue with his valid executive order?

It appears the president is acting in accordance to his constitutional powers and specifically in accordance to laws regarding immigration and has been challenged and overridden by an unconstitutionally political activist (liberal) court.

If so, can he can he continue with his valid orders controlling the actions of the executive branch? No doubt this would set up a "constitutional crisis" but this is going to happen soon anyway as it's the only way we will ever restore constitutional government, ie, the liberal activist courts will have to be toppled eventually. Why not now while we have a strong president and Republican majorities in both housees of congress?

Just askin'.

Okay, not really that important. After I voted the top response at that time was: stop all immigration. Interesting result considering the number of choices to chose from.

Yes, there is presidence where the standing President ignored a Judges order until it all was finalized because the President felt for the safety and security of the United States.

This was FDR when he locked up the Japenese and it was never finalized and they were never let out. AND these were American Citizens!!!!!

I do not know why President Trump is not IGNORING this leftist judge. SOMETHING is up. A deal has been struck by the DEAL MAKER.

Could he have sold our security for his confirmation hearings?

He’s within his authority under the law as well as within the confines of the Constitution to ignore them. I would if I were him.

Then ask yourself, why is he not ignoring him? Why?????

I got through on the second try. Yes, it was interesting to see the results. I voted for Stop all immigration also. It was the first choice of many great possible choices.

Trump can order the state department to revoke all visas from the affected countries. No Visa, no coming to America. All the embassies which issue the Visas are in foreign countries. No US court has jurisdiction at those Embassies.

Expect lots of lawsuits to overturn any new laws that undo Obama care or harm the O’s legacy. The Dems strategy is to put everything on hold by tying the government up in court for the next 4 years. The Constitution is meaningless as written, it’s just a starting point to find “penumbras and emanations” for democrat judges to make new law and change the current law.

If Congress passed such a law, a democrat court, probably the 9th, would put an injunction in place. It seems to me that the judicial branch has gained the superior position in our government over the years.

So was I. I agree he gave that Judge’s ruling legitimacy when he did it. He got some very bad advice from someone in his circle I suspect that was against the EO in the first place. He’s got to learn to trust no one. He needs to simple decree no immigration whatsoever from anywhere for a certain amount of time and then the “Muslim ban” narrative is gone. Then they can hammer him for banning everyone. So what let them wale.

I just wish he hadn’t acted like he had to follow it, if he decides not to, the libs will act like he is burning the constitution when in fact it’s the courts that are.

Don’t think I’ve even heard the Left state he’s breaking the law (yet?). Bet they know they don’t have a leg to stand on...

IMO, that’ll give him the opening he needs to split the 9th a/o remove some activism from the Courts.

Don't disagree the wall was approved by congress. The federal courts will dictate that it unconstitutional to build it. This TRO case was intended to give states standing to sue based upon alleged damage that is complete nonsense. This opens the door to get the federal courts into the immigration control business. The fact that the Constitution does not allow the courts to do so is irrelevant. Overall the the federal courts will allow the dims to continue to import their voters and destroy the Republic. The other two branches of government have not fought back in any significant way in my lifetime. The one chance we had McCain and his Gang of Fourteen sabotaged.

Pres. Trump has an obligation to do so. He swore to uphold the Constitution. Has to ignore this unconstitutional ruling.

Because the real danger is Congress itself - they are merely waiting patiently for an opportunity to impeach Trump for contempt of court.

Ask yourself this question: why has Congress - both the House & Senate - been entirely silent with regard to such an obvious & unfounded judicial usurpation of their legislative prerogative?

It's because the two other branches are playing tag-team on the executive. Congress is using the court system as a stalking horse to expose and draw Trump out into the open.

Recall that Trump essentially drew a line in when he declared DC was acting in opposition to the American people. Do you think they were going to sit quietly and allow that to happen without a fight?

Time will tell whether Trump was naive enough to think that holding only one branch of government was sufficient to launch a successful attack on the other two, or rather this is a purposeful tactic to draw the other two branches into an indefensible position.

For now, all can see that Congress isn't responding - they are explicitly allow the judiciary to legislate from the bench. Oh sure, there have been various declarations of bills to be introduced, etc. But this may be all stalling tactics to allow other, even more divergent opinions & injunctions to be issued from the bench.

The bottom line is that this situation is much more serious than many/most people are realizing, especially if they continue to focus on the judiciary and not the real king pins behind the movement to neutralize & emasculate the president.

Jim, I’m getting old.

I designed consumer computers starting in 1975, I built my own in 1987. I had my first web page in about 1993.

I hate HTML. I learned it but don’t want to keep up with it.

But you are the first place I will go to when I want intelligent input.

Make it easier for all of us.

Let us just cut and paste from Word. Let us just post a picture without knowing HTML.

Congress can halt any/all immigration as it did for 40yrs prior. Couple that w/ the best option I’ve read/heard/seen so far: deny visa from the initial point of request (do judges have any say in embassies/etc.?)

Yeah those EOs looks like they are coming around 1pm Eastern today. No doubt Trump is going to make them as bullet proof as possible.

I’d cite the whole U.S.C 8 statute section in each one. It’s a pretty long code section like stopping foreigners from entry for example cuz they might be sick with communicable diseases. They need thorough healthcare exams from that part of the world.

It is ALREADY customary that Green Card holders that re-enter are subject to review:

What documents do I need to present to reenter the United States?

If seeking to enter the United States after temporary travel abroad, you will need to present a valid, unexpired “green card” (Form I-551, Permanent Resident Card). When arriving at a port of entry, a U.S. Customs and Border Protection Officer will review your permanent resident card and any other identity documents you present, such as a passport, foreign national I.D. card or U.S. Driver’s License, and determine if you can enter the United States. For information pertaining to entry into the United States, see U.S. Customs and Border Protection’s webpage.

So basically, they can leave if they want, but the have been declared as inadmissible if they return prior the 90 day wait and MAY have to be re-screened thereafter.
