A federal appeals court has maintained the freeze on President Trumps controversial immigration order, meaning previously barred refugees and citizens from seven Muslim-majority countries can continue entering the U.S.
A panel with the U.S. Court of Appeals for the 9th Circuit upheld the ruling of U.S. District Judge James Robart, who had decided Friday that Trumps temporary travel ban should be put on hold. The Department of Homeland Security soon suspended all enforcement of Trumps controversial directive.
The Justice Department, representing the Trump administration, could now ask the Supreme Court which often defers to the president on matters of immigration and national security to intervene. The Supreme Court, though, remains one justice short, and many see it as ideologically split 4-4. A tie would keep in place whatever the appeals court decides.

You are sadly mistaken. America already IS being invaded. Your attitude is why European countries are constantly in danger of terrorist attacks from within their country. They are allowing themselves to be invaded. You think an invasion requires uniforms and a recognizable army of some sort. But the game has completely changed.

Allowing enemies of America, like militant Muslims or Muslims who have no intention of embracing our Constitution, to enter our country is an invasion. An invasion doesn’t have to succeed in a short period of time. Allowing enemies of America into our country is allowing an invasion and the feds are strictly forbidden by the Constitution to allow that.
On the other hand, what does it matter whether he defies these “judges” now or later? He tried to respond the ordinary way but it didn’t produce results. In the meantime hordes of terrorists are pouring in. Circumstances are changing and it is more of an emergency. Assad has actually said there are terrorists among the “refugees.”
Sure, it will inspire efforts at impeachment but they may not work. And they will try impeachment anyway as soon as they can. Some old bag was wearing a big “Impeach Now” button on the bus yesterday.
Possible theoretical parallel: If the UN had not approved Papa Bush’s entering Kuwait, and Saddam had then proceeded to enter Saudi Arabia, might everyone have agreed that it was more of an emergency? Even the huge increase in men from the named countries entering as fast as they can makes it more of an emergency.
Whatever he does, he will be vilified by the Left and the media. He can’t go around tiptoeing to avoid impeachment by these morons.
Especially since the Left has almost taken over SCOTUS, as many here have said, it would be a gamble, besides being more of a capitulation to the Judiciary, and a waste of precious time.

I agree that the 'proceed cautiously' approach, is the wrong way to go - especially in the case of this president - who has consistently won by ignoring the advice and admonitions of the weak sisters on our side.
Trump won the presidential election precisely because he's a Type A, alpha male, who has the courage to look evil in the eye and spit in its face.
He's not going to win this thing by playing by the enemy's rules, or allowing himself to be suckered into their traps. He's got the law and the Constitution on his side in this matter, and needs to exert his authority NOW, or be permanently neutered by the left.
If I were President Trump I would sign an EO tomorrow morning that says that everyone who enters our country from those 7 countries must be detained at the airport, or at the Embassy for their country until they can be properly vetted. They would not be free to walk our streets until they are completely vetted, so come on in, but be prepared to be detained for as long as it takes.
I think it would be far more effective for Trump to win this current battle, than to retreat, launch a new offensive, then resort to defense, then. He'll be in a fundamentally weaker position if he goes that route, rather than standing firm on his legal, constitutional authority NOW.
He's got to answer this abrogation and nullification of the Executive on THIS ground, not anywhere else. The court has just seized the palace, and he must take it back before he's powerless to do so, which he will be, if he doesn't crush the coup right here and now.

Agreed. He needs to push back HARD on this, and he's got the full weight of the law and the Constitution to help him.
There just is no need for him to go slow or craft some complicated counter strategy. He just needs to stand up to the court and call it for what it is - a treasonous usurpation and nullification of the presidency.
The 9th Circuit and the Seattle judge have just overturned the government, and need to be met with something a lot stronger than, "I'll see you in court."

They can’t be vetted. They have no papers and no one can prove who they are. Impossible to even keep track of them once they are here. Assad just said it: no one knows who they are.

However, we could still save our country. All immigration into the U.S. is determined by the legislature and executive. All we need is for someone to grow enough backbone to say that we need to restrict immigration in TOTALITY. And we do. So the 9th Circus says we can’t discriminate based on religion as they say. Fine. We can just dramatically lower refugee quotas and lower all legal immigration allotments. Start making it a political issue for Republicans and force them to take a stand one way or the other so we can “vet” them out and put people in power.
Trump has shattered the liberal-imposed concrete ceiling against criticism of immigration. We must run with it forward.
Work the appeal so that it can’t be deadlocked. Find some way to get one of the justices to recuse due to a conflict. A bit of research, and it can be done. If not, try again after the new justice is sworn in, and in the interim be highly exacting of all refugees, perhaps reopen Ellis Island and Alkatraz as processing centers to “deal” with the huge influx. Make it easy to deport them. What else can you do. The rule of law has been highjacked and aimed at the White House. Let whoever can roll roll, any way they can.

I heard yesterday on the news briefly while getting ready for work that we have spent 300 billion or something like that in the 15 years of being in Afghanistan and what do we have to show for it? (On top of American lives lost) The military dude said “It is a stalemate.” It’s enough to make you wanna cry.
Then we will have to meet them there. Or I suppose just sit back and worry about ourselves and our own families, mind our business and get used to the new normal. But whoa to our grandchildren and greats. Imagine what kind of America they will grow up in.

It appears 'precedent' is no longer important in law.
What they teach in law school is that the collected opinions of Federal courts are Talmud to the Torah of the Constitution.
As such, they don’t CHANGE the Constitution - not exactly, anyway - but as they accumulate over time they alter irrevocably the way the document can be used to govern us.
