Federal appeals court maintains suspension of Trump’s immigration order

A federal appeals court has maintained the freeze on President Trump’s controversial immigration order, meaning previously barred refugees and citizens from seven Muslim-majority countries can continue entering the U.S.

A panel with the U.S. Court of Appeals for the 9th Circuit upheld the ruling of U.S. District Judge James Robart, who had decided Friday that Trump’s temporary travel ban should be put on hold. The Department of Homeland Security soon suspended all enforcement of Trump’s controversial directive.

The Justice Department, representing the Trump administration, could now ask the Supreme Court — which often defers to the president on matters of immigration and national security — to intervene. The Supreme Court, though, remains one justice short, and many see it as ideologically split 4-4. A tie would keep in place whatever the appeals court decides.

So now we are supposed to hope for a terrorist attack because that’s the only way we can get the country to see that the Judicial/Leftist coup-de-tat was wrong?

If he has “numerous ways to circumvent the 9th Circuit” then I suggest he use one now. However, as it sits he has pretty much no power on the issue of national security, immigration, border control or refugee admissions. The United States effectively has no borders and the President has no ability to control entry in the nation. This is beyond what Hillary said when she called for an open hemisphere...we have an open world right now and no way to stop anyone from coming in for any reason.

Some propaganda points blaming terrorist attacks on the Democrats and the Judiciary doesn’t give me much sense of security.

No, then all hell would break loose. The media would be running stories on front pages and on TV 24/7 calling him a rogue president who should be impeached.

The media is already doing that, and congressional Dems are already on record calling for his impeachment. The left has already set that game in motion, so it doesn't matter what the President does, or does not do about this.

You want to talk about optics? It would be one of the greatest, most memorable moments in our history, if Trump stood firm and told the courts to shove their illegal usurpation of power up their collective wazoos.

People around the world would cheer to see a real leader stand up to such heinous depredations.

Congress was intended to be the strongest branch, then the executive, then the judicial, which merely interprets the law according to the Constitution.

Outlaw libs have turned it all on its head.

Reality hit during the primaries. Too few people had a clue about delegates and the process because they had left off or never had any personal participation in politics at the most local level.

People too unmotivated to spend more than a few minutes in a voting booth a few times a decade certainly aren’t going to make history-changing sacrifices to restore self-government. They’ll spend their few minutes voting for a man on a white horse and hope for the best.

Who is he listening too that has him knuckle under to a lousy district judge?

I asked that question on the night this all began.

The President could have stopped this mess in its tracks, had he simply issued a statement saying that judge Robarts had overstepped his jurisdiction, and had ruled against the well recognized legal authority of the President.

The whole thing is absurd. Judge Robarts might as well have ruled that the 1st Amendment of the Constitution is illegal. Who would pay attention to a nonsensical ruling like that? Who would bother to even challenge such idiocy in a court of law?

I'm afraid the President only validated the authority of this judge and the judicial branch by agreeing to be bound by his restraining order.

It's a potentially catastrophic precedent.

I’m holding out by a thread of hope, that any minute now, Trump has some sort of poker hand he throws down and blows this all away. As each minute passes, it appears not to be the case...

Trump has only one effective move he can make, and it's not inside a courtroom.

He himself has to first recognize that his presidential authority to restrict entry into this country is already etched in stone.

Secondly, he needs to grasp that the court has no jurisdiction to rule on said ironclad authority. Only the Congress is constitutionally authorized to make law concerning the powers of the presidency.

Thirdly, he needs to be willing to end this crisis by yanking the entire country back to reality. He needs to stand up and tell everyone that he is vested with certain powers which have been granted to him by the people and their representatives, by federal statute law, and by our Constitution.

Further, it is NOT within the purview of any officer of the court to abrogate that authority.

If he does not do this, the rest of his term will be a never ending battle with the judicial branch, thus neutering him and his agenda.

Article IV, Section 4 absolutely trumps the valid or invalid TRO/restraining order.

I don't see how Article IV Section 4 applies at all. This has nothing to do with ensuring a republican form of government for the states, and there is no invasion or threat of invasion to the United States.

What was bad about that is that Obama was actually breaking federal immigration law and making his own yet the court was telling the state that was trying to enforce federal law that Obama could do whatever!

Yes, you put that PERFECTLY into words, far better than my current ill temper would.

What bothers me most, is that I have high regard for Trump and his staff. I cannot fathom how they went from RULING, to ASKING PERMISSION.

Asking permission to rule has now opened Pandora’s box.

I would never advocate a terrorist attack to prove a point nor would I advocate circumventing the Constitution either.

The Court said the Government failed to show a risk of terrorist attack from the countries named. They looked at policy rather than law, even giving weight to statements made by candidate Trump and Rudy Giuliani.

Having included material that was outside the scope of the order, they’ve set the bar. If anything were to happen, how would they explain it away?

I think the Administration will do something. In watching the President interact with the press this evening, I get a feeling that there is a lot more to this than meets the eye. Especially now that Assad has said that some terrorists have secured passports.

This Executive Order was put in place a week ago. We just came off 8 years of open borders. Our sense of security has been at risk for quite a while.

You are so correct. This is frightening. Unless the damage can be fixed by some miracle, this is now headed for the ugliest of conclusions.

For example, if Trump now takes action that is deemed to violate the court, or ignoring the court, he’s emboldening riots/protesters that whatever he action he takes is that of a dictator.

Well, if the cities then burn, who the hell you blame for that?

So now he’s a dictator unless he takes it to the Supreme Court, where it will be 4 to 4.

And worst of all. Anything, and I mean ANYTHING he tries to do going forward will come out of the 9th. And the very second that some liberal takes the WH next, they’ll laugh in our face and say that we were fools for playing above board, now it’s back to the same thing we’ve seen under Obama and Clinton.

A group of men in black robes has declared that FOREIGNERS have constitutional rights, and AMERICAN CITIZENS DONT!!!

These men are lawless, renegades, basically overthrowing our government. I dont think I’m being melodramatic. They have basically overturned the powers of the executive branch. Coup d’etat by George Soros’ minions.
