"Otherwise the would release it right away to prevent others from coming in under the wire." No, they said they would provide advance notice of a ruling.

Mine also. Its their way of stalling Trump. Obviously political because the law is obvious. One reason I despise the black robes is that they have no regard for law and justice. ping.
It has been my observation over the years that this is, by far, the most common consensus on the topic among conservatives. The Judiciary has become a threat to the nation, and it needs to be changed up from top to bottom.

Well said. On the issue they may agree with Robart, but legally and politically it would be a very bad move on their part. Delaying the decision allows as many aliens as possible the opportunity to get in the country before the gates close.

Sweet. Right at prime time.
Not looking promising.

In case of a loss on this issue, can Trump make other orders which are similar? Can he ban all immigration in the interestof National Security? These judges are stupid. He can order the state department to revoke all visas from the affected countries, and issue no more.
What are the judges going to do? They are going to scream and whine and bitch and yank out their hair.
Same result, and he can tell the judiciary to go F*** themselves if they think they can stop him.
This is an incredibly stupid place to pick a fight with the President. They can't win it, and he will demonstrate to them how powerless they are to f*** with him.

Delaying the decision allows as many aliens as possible the opportunity to get in the country before the gates close.
Which was the reason they did this in the first place.
To: Red Badger
I suspect that whatever the outcome, the "loser" will appeal for an en banc hearing of the full 9th.

My reason....They don’t want to be put down by the Supremes.
...
That makes sense, but the Supremes put them down all the time. They’ve got no sense.

From one article I read that included one of the exchanges between one of the justices and DOJ lawyer the justices are considering questions that are not even before the court. So in my opinion the justices are looking for any reason to uphold the stay.

Signs in the past couple of days seem in a general way to point to a ruling against politics and on the side of law and order.
If you're correct it's for one reason and one reason ONLY. Congress has begun to talk seriously about busting up the Ninth Circus.
To: DrDude
No. Because it would be mean.

They should be assigned solely to the territory of Guam, and a new court of appeals created for the Left Coast.

Suspect that most here are on target...It will be a political decision poorly disguised as a legal ruling.
Can’t wait to see the unbiased analysis of CNN and MSNBC tonight. /s

I'm going to say 3-0 for us.
Can't find anything unconstitutional in the EO.

Probably 5-3 in favor of the injunction: look at Kennedy's ruling in
Boumediene.
The judiciary is the Left's last line of defense. Lawsuit by lawsuit it will simply strip the executive of control over the Federal bureaucracy until the people make the "right" choice.
