Utah House calls for constitutional convention to rein in federal government

The Utah House called Friday for a convention of the states to consider new amendments to the U.S. Constitution, which supporters said is the only way to rein in an out-of-control federal government.

It passed HJR3 on a 45-29 vote, and sent it to the Senate for consideration.

The resolution calls for a convention that would consider amendments to "impose fiscal restraints on the federal government, limit the power and jurisdiction of the federal government, and limit the terms of office for its officials and for members of Congress."

"We are in jeopardy of losing our republic," said HJR3's sponsor, Rep. Merrill Nelson, R-Grantsville. "States are no longer equals in our government. States must be restored to their roles as sovereign, equal partners."

A convention of state is our right under the Constitution. It’s time we exercise that right.

The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress; Provided that no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article; and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate.

Have you read Article 5? A Convention of the States requires a vote of three-fourths of the states in favor of an amendment.

Currently the Republicans control more state legislatures since any time since Reconstruction. And these are relatively conservative Republicans.

Submit amendments. Let them run their course.

The method you suggest starts with the very people in congress that are abusing the constitution. People like Nancy Pelosi that laughs at limits on government power. Do you really think that they are going to pass resolutions for amendments that will restrict the power to which they are addicted? So you think that the Democrats are ever going to let an amendment pass through congress that will limit the power of judges to legislate from the bench?

No. The Convention of the States is the only way we are going to pass Amendments that will reign in government overreach.

I hate to hear that but I expect you are right. If the Mormons are against it in Utah it will be a tough fight. Still our best option to support President Trump in getting the swamp drained.

Who has submitted amendments to the House or Senate?

We have the majority.

I know it is to go to the Senate here in Utah, but I don't know how it will be received...they should have added something about ‘our lands being given over’ by Barky, because everyone in Utah is upset over that...but Constitutional Convention...with polygamy involved, you know that is one of the conditions that Utah became a State was they had to do away with polygamy...

Thank you for posting the Article V excerpt. People seem to forget that it’s a well-thought power given to us by the Founding Fathers for just such a time as this. The Constitutional Republic they created was destroyed by amendments the marxists put thru Congress in 1913. In doing so they ran roughshod over the rights of states guaranteed by the 10th Amendment as well. It is past time that our states took back some of their rights with an Article V Convention of States. I salute Utah today for passing this and giving us another small step on the journey.

I’m praying those Utah senators see the big picture including the federal land grabs. I’ve spent the last 2 months working on getting this passed in Texas. We’re still one little piece of the big picture and I rejoice with every victory nationwide.

I don’t know.

What would be the point? Is a senator going to move a resolution to the floor limiting the terms a senator can serve or repealing 17th amendment providing popular election of senators?

The amendments needed to restore limited government would be opposed by Republicans as well as Democrats; At least enough Republicans to prevent passage.

Just look at a simple thing like auditing the Federal Reserve has not moved through congress because it challenges the power structure in Washington DC.

I don’t understand the fear of a Convention of the States. ¾ of the states have to approve. I don’t see anything radical being approved at this point in history with conservative legislatures in the majority of the states.

The US congress is not going to present amendments curtailing their own jobs and powers. Those crickets are exactly the reason the states are trying to organize UNDER THE CONSTITUTION to present Amendments per their RIGHT under the Constitution. We have an alternative to Congress. Let’s use it!

Reminds me to set aside tomorrow for another round of phone calls and emails to my Texas reps. Gov. Abbott told them its an emergency. They need to start acting like it.

Actually that is the whole of Article 5.

I wholly agree that the 10th Amendment is the most ignored amendment in the constitution and at the time of the ratification of the Bill of Rights it was considered the most important.

i do not want a Constitutional Convention.

We have spent 30 years trying to deal with RINOs across the nation implementing all sorts of whacked out stuff.

I think you are kidding yourself if you think nothing bad crafted could possible be implemented.

Look at the grief Trump is getting from Republicans for some of his plans.

Honestly, I DO NOT trust the Republicans either.

Am I glad our state houses are lop-sidedly Republican? Sure. Does that convince me Conservatism would prevail? No.

I can’t count the number of times I’ve seen a Republican say, “reasoned gun control”.

So no, I don’t want to open things up for review.

Those 29 people are the entire group of D’s. They are almost all from SLC. They continually whine about how powerless they are in the legislature. Where’s that boo-hoo girl graphic?

I do think there are good arguments to be made both ways on this.

I do consider myself to be somewhat obstinate about it, but this has been my take on it, right or wrong.

Submit bills to change things.
