Appeals Court Denies Justice Department's Motion to Lift Travel Ban Restraining Order By DEAN SCHABNER DAVID CAPLAN Feb 5, 2017 The U.S. Court of Appeals for the 9th Circuit announced early Sunday morning that it has denied the Department of Justice's emergency motion -- filed late Saturday -- to issue an immediate stay on a Washington State judge's temporary restraining order of President Donald Trump's controversial travel ban.
"The court has received appellants' emergency motion (Docket Entry No. 14)," read the order from the appeals court. "Appellants' request for an immediate administrative stay pending full consideration of the emergency motion for a stay pending appeal is denied."
Lawyers from Washington State and Minnesota, who brought the challenge to court in Seattle, have until Sunday at 11:59 p.m. Pacific Time to file a response to the Department of Justice's request. The Justice Department then has until Monday 3 p.m. Pacific Time to file a reply brief.
Lawyers for the Department of Justice argued in the filing that the restraining order is "vastly overboard," and it "second-guesses" the commander in chief.

This is where Obama and Trump differ.
Let us say the roles were reverse, and Obama wanted this Executive Order to be carried out.
Obama would purposefully pack the crew being imported with hardcore terrorists (and maybe even equip them and instruct them to act immediately) to show how right he was. He'd gladly let America take a few shots to get his way (eventually).
Trump won't.
Or between the judiciary and the American Patriots.
This is not legitimate action by the courts. Trump is going to have to go around the courts somehow to get his policies enenacted or else everything for his entire presidency is going to be decided by the scotus. Permission from the courts to wield presidential power? This can’t be.
It’s a win-win for us either way.
For all of Obamas term the mantra was that immigration was solely the power of the federal government and specifically the power of the executive office. So the states had to take all the immigrants Obama forced down their throat.
Now the courts have suddenly decided the states have a voice in the matter and can demand immigrants in their borders. Well if they have the right to demand immigrants - they have the right to deny.
Ultimately though this proves we’re no longer a nation of laws but that the leftists will continue to run on a “words mean whatever I want them to mean at that point in time.”
Just what checks and balances do the exicutive and legislative branches have over the judicial branch?

Yep. Expected it from the 9th Circus.
Supreme Court in 2012 in the rush to slap Arizona already said the feds set immigration policy and law.
So the lower courts can pound sand on that.
The Democrats will be fully aware of that and use it to block Gorsuch. It will motivate their base. They would have to go nuclear.
The 9th will hear the case the arguments are due tomorrow and Monday.
It is high time to quickly hit the link of your elected officials and tell them “NO MORE MUSLIMS” period.

Can he remove all of them from their positions for not upholding the Constitution? What if he does this and it goes to the SC and now, without Scalia, they turn him down?

No. Entirely believable with the 9th Circus. Congress has the power to regulate the size and jurisdiction; they should shrink both down to the bus station in San Francisco and put its court in the mens’ crapper.

Yeah, the Arizona thing bothers me. Obama and the left got SCOTUS to jam down the State of AZ to prevent them from enforcing any immigration laws. That opinion was pretty clear.
If we’ve reached a point where the States of Washington and Minnesota have a judicially recognized interest in importing non-citizens, the country is screwed.
I would like to see more play on the MN angle here. I’m not so sure voters in MN are thrilled about this given their Somali issues.
Some of us here last night knew this would happen. I hope trump has people that knew this too and that he has a well thought out plan
