Washington (CNN)The Justice Department on Saturday moved to appeal a decision that temporarily halted enforcement of President Donald Trump's travel ban. The appeal concerns a late Friday decision by a US district court that halted the enforcement of Trump's executive order. Trump's policy banned travel to the US from seven Muslim-majority countries for 90 days, suspended all refugee entry to the US for 120 days and indefinitely suspended entry for Syrian refugees. A notice of appeal was sent Saturday night to the US district court, where Judge James Robart, a George W. Bush appointee, presides in Seattle.

I'd much rather see President Trump send the Marines to every international port of entry. and tell Customs & Immigration that they WILL obey the lawful orders of their Commander In Chief, or they will be arrested on the spot for treason and gross dereliction of duty!
He needs to get Sessions and his SCOTUS pick safely confirmed, then he's going to go all out. Trust me, Trump isn't the greatest negotiator in modern American business history for nothing. Also he's got Steve Bannon from Breitbart on his side.
Trump has the law firmly on his side. But he's not going to risk throwing this country in flames. Everything will work out in the end. This judge will get smacked down, Trump will get his cabinet assembled, and they're going to go hard on this issue.

A guy like Bannon anticipated this and is going to nuke it to smithereens within the next week or so. You FReepers keep doubting and underestimating Trump and keep getting fooled.
It’s not game over if the 9th Circuit shoots him down.
He’ll have the SCOTUS. Further, he doesn’t have to file right away. It will make it dicey on the current set of people frozen out, but it will eventually be approved.
Once we get Gorsuch on the SCOTUS, Trump prevails.
Once again the 9th Circuit Court will look like a bunch of buffoons.
Now, all that being said, the 9the Circuit Court has had some interesting rulings in the last couple of years. I wouldn’t rule them out striking down the lower judge’s order, but I do still see it as a long shot.
Since he has gone this route if the 9th upholds the Judge he waits till Gorsuch is seated before the SC appeal? Well that would add to confirmation fireworks that’s for sure.

Exactly, and our president shouldn't have allowed himself to be talked into taking this fight to the judicial branch AT ALL.
He should have told this judge that his ruling is null and void on its face, because his EO is firmly grounded in statute law and the Constitution.
By taking this to the courts, President Trump is asking the left for permission to be president. Bad move!

No, YOU don't understand. Trump is letting a circuit court judge usurp his legal, constitutional authority in this matter. To make things worse, not only is he not asserting his well grounded authority to enforce his EO, he's now appealing to the judicial branch to give him permission to act as president.
Wrong move, and my gut tells me it wasn't Trump's first instinctual response. My guess is, he was talked into making this pussy play by members of his advisory team.
Now that he's done it, things will play out exactly as most Freepers could have told him. The 9th Circuit will uphold the lower court ruling, throwing it to the Supremes, who will predictably deadlock, which then throws it back to the 9th Circuit decision.
Result? The President's authority under statute law and the Constitution is rendered null and void.

It's a terrible strategy to rely on the courts to uphold the already well established legal and constitutional authority of the President.
President Trump is well within his legal and constitutional jurisdiction to tell this judge to pound sand.
By seeking legal redress, the President is actually ceding his authority over the executive branch of the federal government to a circuit court judge.
Bad move.

9th circuit may surprise us, it’s happened before, and as you point out “Trump has the law firmly on his side.” They may just rule for an emergency stay.
Ask this crap for what is a temporary policy to begin with.
I gotta say l think YOU are right, this was an opportunity to finally, finally put one of these activist Judges in his place so now it looks like Trump is stuck playing a losing game.

I think that Trump will eventually win the war, but he litened to his pussy advisors on this one battle, which will cost him, and us.
Obviously, the circuit court judge's ruling must be overruled, as Trump's EO is firmly grounded in statute law and the Constitution, but the President has lost face in the court of public opinion, by allowing his ironclad authority in this matter to be usurped and nullified by a single low level functionary of the federal judiciary.
It's a terrible strategic mistake on his part, which I hope to never see him repeat.
So how will Trump pull out of this and correct course? He has a long period of judicial activism to undo. Not impossible, but certainly not easy.
First of all, he needs to stick to his guns and not let his inner circle of advisors do anything more than advise. He's the President, and they're NOT, for good reason.
It's his gut instincts that got him to where he is today. He needs to seek his own counsel when faced by a crisis like this, and trust that those instincts still serve him, as they always have.
He is now the President of The United States of America, and must fully assume and accept that mantle. It's probably the most important thing he can do at this early stage of his presidency.
He's been accustomed to being the boss for most of his adult life, so I'm sure it will come easy. What I'm sure hasn't come easy for him, is the level of gross insubordination and push back he's now receiving from those he views as his underlings.
I think Trump has more of the 'right stuff' to do this job than anyone in living memory. He just needs to be who he is, and get on with it. Everything else will fall into place.
