Rioters: Article I, Section 9 of the Constitution

"The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it."

This is the powerful weapon that the federal government can use in dealing with the new wave of violent fascism that is infecting our nation.

At what point can it be used?

Can it be used in the arrests of people who incite the rioters?

Rioting is already against the law. But I wouldn’t want the federal government getting involved, regardless; states should be handling this.

Not to say that states which do NOT quell riots should get any federal money.

In this case I support the Feds getting involved as it is a nationwide problem and a nationwide conspiracy.

Interesting in that the powers granted by Section I are for the Legislature, but enacted by the President, whose powers are enumerated in Section II.

Crossing state lines for the purpose of rioting or funding riots in a different state are against FEDERAL law. The FedGov doesn’t need to suspend Habeus Corpus, they just need to RICO Soros and every single leftist organization he funds, directly or indirectly.

I think Article IV, Section 4 would be more applicable: " The United States shall guarantee to every state in this union a republican form of government, and shall protect each of them against invasion; and on application of the legislature, or of the executive (when the legislature cannot be convened) against domestic violence."

No state has requested intervention so far as I know.

At some point, the failure to enforce law and keep the peace becomes a violation of the equal protection requirements of the Constitution.

Not to mention “shall ensure a Republican form of Government”.

There are also laws which allow the POTUS to put down insurrection.

You make a good point, but as conservatives, we have always wanted local unrest handled by states. The precedent of federal government overreach in the past has brought us to our present condition.

I’m not saying it’s not warranted, but we should be very reluctant to seek this remedy.

Not that I can find. A People Inflamed, a City on Fire or Mr. Lincoln & New York. But then I did a quick search, and none that I looked at mentioned anything even remotely similar to that claim.

I wouldn't call it that. Once it moves into violence then it's rioting. But still a far cry from rebellion.

And the villains in California won’t. They DO want to secede and Secesh need to be met with steel and lead. Give the rest of the country an chance to purge the entire state of the freaks that afflict the normal citizens there.

I brought this argument forward because I want people to know of some powers that the Constitution actually grants to the federal government. It’s not so that they will use it, but when they actually bring the rioters to court the perps will realize that felony rioting charges are just the start.

As one wise person noted, these rioters are just the tip of the iceberg that wants to take this country down. It does concern national security and it is important to stop these rioters.
