WASHINGTON — Acting Attorney General Sally Q. Yates, a holdover from the Obama administration, ordered the Justice Department on Monday not to defend President Trump’s executive order on immigration in court.
“I am responsible for ensuring that the positions we take in court remain consistent with this institution’s solemn obligation to always seek justice and stand for what is right,” Ms. Yates wrote in a letter to Justice Department lawyers. “At present, I am not convinced that the defense of the executive order is consistent with these responsibilities nor am I convinced that the executive order is lawful.”

The AG’s job is to represent the United States Government and its laws on the books. It is not to decide what is “right” or “wrong”. Fire her for refusing to represent her client on a clear case of administrative constitutional power exercise.
Reading J. Christian Adams book on the Obama DOJ and it is clear the department is riddled with people who feel they have a calling to ignore laws they don’t like.

Absolutely. This is a trap. The rats made hay of it when Nixon fired several acting attorney’s general in a row. It was called the Saturday Night Massacre.

A better strategy is to appoint an awesome SC justice and force the destruction of the filibuster on that and or Sessions. If DHS is enforcing the EO, who really cares if the acting AG is in agreement?

I have no idea. That is a good question. Exactly how long can they delay on Sessions? With this seditious AG in place, they will stall as long as possible.
LOL - good idea. He sleeps about 4 or 5 hours a night, and odds are strong that she would have problems with either the 5 AM or the 11 PM meeting. :)
If that is accurate, then we have already lost. Her attorneys can go into court representing the US and settle each of the cases against the Executive Orders with a binding agreement approved by one of the Leftist Federal Judges. Then Trumps hands will be tied and such agreements could well extend to other areas like environmental challenges. How long will it take Sessions to get confirmed and appointed? An enemy DOJ can do a lot of permanent damage.
