Yes it would or as said in article maybe sooner if a Trump nominee was confirmed.

A recess appointment would last for two years.

Congress would probably expand the High Court if Obama tried it.

The size of the SCOTUS can be changed by statute.

Recessentially appointments only last until the next congress is convened. So Garland would not last long enough to be sworn in.

The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.

The read says yes, one year OR sooner if DJT appoints and senate approves replacement.

That slimy sneaky little shit Obama is on his way to jail eventually . The constitution he so despises will put him in prison eventually. Yeah this intercession appointment is legal but the ink won’t dry before Garland is out and also out of his previous job IMO.
