Obama expected to invoke 1953 law to indefinitely block drilling in Atlantic and Arctic oceans

President Barack Obama is expected to move to indefinitely block drilling in vast swaths of U.S. waters by invoking a provision in a 1953 law that governs offshore leases.

The announcement is anticipated as early as Tuesday, people briefed on the plan told the Associated Press. The White House declined to comment to the AP.

The law allows a president to withdraw any currently unleased lands in the Outer Continental Shelf from future lease sales. There is no provision in the law that allows the executive's successor to repeal the decision, so President-elect Donald Trump would not be able to easily brush aside the action.

Trump has vowed to open more federal land to oil and natural gas production in a bid to boost U.S. output. Obama's move would essentially put most of the Arctic and Atlantic oceans permanently off limits, though the prospects for drilling in the affected areas in the near future were already questionable.

Obama is setting it up so that every action taken to open up energy development in the US will be challenged in court. Trump can overturn this decision anyway, but the lawsuits will fly. Trump probably will need Congress to repeal or limit the 1953 law.

Trump can and will reverse all of this. EO’s are easy. This 1953 law will be a bit more difficult. Trump will be depicted as a nature and environmental hater while he’s at it.

Nope. Sorry but this is Fake News. There is no ability in the law for a President to obligate future Presidents via EO.

Doubtlessly they think they can do it but because they THINK they can does not mean they actually have the legal authority. A Judge, and their will be immediate lawsuits, can rule against him. I think O and his admin hold the record for the number of times the Judiciary has overturned their executive overreach.

In addtiional there is the little problem that Congress can simply repeal the potion of the law they attempt to abuse and render him void.

Maybe. Unless he's already being depicted as a war monger, hater of women, despiser of the poor, ignorant vulgarian and incompetent. Scott Walker showed you can overload the left. He started in on all sorts of other stuff during the Act 10 fight. Trump has the will and the ability to take it national.

He should just respond the way California’s governor did for homo marriage. The oil companies should sue, and Trump should order DOJ not to fight.
