When Donald Trump threatens to lock up Hillary Clinton if he were president, he's merely "channeling the frustrations of millions of Americans" and doesn't ultimately have that power, his campaign manager suggested Wednesday.
"It wouldn't be up to him whether or not she goes to jail.That would have to be fully adjudicated through the regular channels like it would be for anyone else," Kellyanne Conway said on ABC's "Good Morning America."

He can’t. That’s true.
His Attorney General can make it a top priority to investigate the Clinton Crime Syndicate.
He can determine probably guilt, issue indictments, and prosecute her to the full extent of the law.
Anything that the statute of limitations hasn’t expired on, should be fair game.
I hope some of the rape victims saved bodily fluid samples.
He said he'd appoint a Special Prosecutor, and as long as it's not Ken Starr, then it's a slam dunk!
The president has the power to pardon. That’s in the Constitution. He doesn’t have the power to grant blanket immunity from future prosecution.

I think someone has to be convicted or at least charged to be pardoned. How can you pardon someone who has done nothing wrong?

I don’t think he can issue a valid pardon without a specific conviction to define the pardon.
IOW, she can still be prosecuted, without “Double Jeopardy” if she was never tried in the first place.

sounds good . . . there can not be double jeopardy if there is no previous adjudication of the crimes.
She cannot be pardoned before adjudication for treason. That is a constitutionally mandated capital offense.
I don’t think Obama pardons Hillary if she loses. It would be more divisive long term for the country if she isn’t and I think Obama values divisive. Anything to hurt the US.

Without a conviction it would be impossible to establish which treason was being pardoned. (Known treason, or undisclosed treason?)
