Conway: It's Not Up to Trump Whether Clinton Is Jailed

When Donald Trump threatens to lock up Hillary Clinton if he were president, he's merely "channeling the frustrations of millions of Americans" — and doesn't ultimately have that power, his campaign manager suggested Wednesday.

"It wouldn't be up to him whether or not she goes to jail.That would have to be fully adjudicated through the regular channels like it would be for anyone else," Kellyanne Conway said on ABC's "Good Morning America."

He can’t. That’s true.

His Attorney General can make it a top priority to investigate the Clinton Crime Syndicate.

He can determine probably guilt, issue indictments, and prosecute her to the full extent of the law.

Anything that the statute of limitations hasn’t expired on, should be fair game.

I hope some of the rape victims saved bodily fluid samples.

The president has the power to pardon. That’s in the Constitution. He doesn’t have the power to grant blanket immunity from future prosecution.

Luckily he can’t pardon himself.

That being the case, he’ll be the focus of many things should should have been.

I think someone has to be convicted or at least charged to be pardoned. How can you pardon someone who has done nothing wrong?

He is correct.
It is first up to a grand jury to indict and then to another jury to convict.
But just getting to the discovery process might be worth while.
Might have to lock up half of DC after it is done...
But it is all wishful thinking. Won’t happen.

I don’t think he can issue a valid pardon without a specific conviction to define the pardon.

IOW, she can still be prosecuted, without “Double Jeopardy” if she was never tried in the first place.

She cannot be pardoned before adjudication for treason. That is a constitutionally mandated capital offense.

I don’t think Obama pardons Hillary if she loses. It would be more divisive long term for the country if she isn’t and I think Obama values divisive. Anything to hurt the US.

Wrong, there is no such constitutional limit on a president's pardon power.

Article II, Section 2, US Constitution:

"...he shall have Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment."

Let me ask you this though.

Nixon was pardoned. That seemed to exclude him being charged.

Yep. If, and only if, the chief executive orders that the adjudication take place. Which 0bama, in complete dereliction of his duties as President, has not done.

Louis Foxwell is correct.

Without a conviction it would be impossible to establish which treason was being pardoned. (Known treason, or undisclosed treason?)

Your view of the constitution is way too simplistic.
