FBI Director James Comey should resign, according to former U.S. Attorney Joseph DiGenova, after giving immunity deals to Hillary Clintons chief of staff Cheryl Mills and four other aides in the investigation over the former Secretary of States use of a private email server for government business.
Matthew Whittaker, another former federal attorney, told The Daily Caller News Foundation that Congress should know why the Clinton aides were treated differently than any other investigation has ever been done.
Mills got the immunity deal after refusing to let investigators examiner her computer, according to the Associated Press, ..
This now gets to the point of a serious question as to the directors fitness for office, DiGenova told TheDCNF. He said a grand jury should have been convened and they should have issued a subpoena for Mills computer.
You go to a federal judge, you get a grand jury subpoena and you fight that out. He didnt want to do that. And neither did the Justice Department, DiGenova said.
The contours of this investigation are so embarrassing to the FBI because it is now clear that they immunized people who had criminal exposure and did not conduct a proper investigation before they gave immunity, he said.
DiGenova called for Congress to hold hearings with Comey testifying under oath and to consider sanctions such as censorship or impeachment, although he doubted that Congress would impeach the director. A hearing is scheduled for Sept. 28, 2016, before the House Judiciary Committee.
This was not a real investigation, added DiGenova. This was a protected investigation designed to look like an investigation. He called it a politically corrupt investigation.
I think its an appropriate role of Congress to ask why this group of Clinton people was treated differently than any other investigation has ever been done, he said.
DiGenova also said he was surprised that given her immunity, the FBI allowed Mills to attend Hillary Clintons interview at FBI Headquarters.
Not only was she given immunity, but she attended Hillary Clintons interview. It is the first time in history that an immunized witness has attended an interview of the ultimate target of an investigation. This is one of the single most embarrassing moments in the history of the FBI, DiGenova said.
DiGenova was the U.S. Attorney for the District of Columbia and also served as the Independent Counsel in the Clintons passport case. Whitaker was the U.S. Attorney for the Southern District of Iowa.
Impeachment. An immunized defendant gets to hear the principal's testimony because she's allowed to attend it.
That is unheard of.
No, he shouldn’t. He should hang on until right after President Trump’s swearing in and he tweets out, “You’re fired!”
One of Trump’s first orders must be to fire Comey.
That is damning. The establishment does not typically eat their own. Not in public, anyway.
The whole FBI should resign. They have squandered their own integrity. Comey should be prosecuted for Obstruction of Justice.
Comey should be in jail, along with Hillary!
The thing with the Clinton Foundation is so big it could bring the whole government down.
The emails alone have now enmeshed the POTUS, who broke Federal laws by using the pseudonym and unsecured communications.
This is only the tip of the iceberg.
Before we used to have corrupt individuals.
Now we have an entire compromised, corrupt government.
Trump is the only chance we have to break their power.
This election is for all the marbles, on multiple levels.
I hadn’t thought of obstruction, but it clearly is, isn’t it?
Comey is probably counting on a Hillary win, in which case he will be on good terms with the new administration. If Trump wins, he can resign and get a well-paying position at the Clinton Foundation.

“One of Trumps first orders must be to fire Comey.”
Unfortunately, it isn’t that simple. The President appoints the FBI Director for a term of ten years, but he cannot dismiss the Director without cause. OTOH I am quite certain that President Trump will know what needs to be done to off this prick!
If Clinton loses, her cash-flow is going to disappear. The reason for others giving her money will be gone...at least until Chelsea gets of age and experience to run for the senate.
The FBI is one big joke. Screw them. Democrats don’t resign. They double down.
Should also tell if he was unduly influenced in any way.
I did not know Mills attended Cinton’s “interview.” That is indeed unprecedented, unprofessional and unethical.
Not only did she attend, but she attended while immunized. And acting as her lawyer which has been claimed, she could verbally instruct with parsing, word choice, legal peril, etc. with no threat to herself.
It is corruption at the highest level.
He is a candidate for accomplice after the fact. They need get every agent who had anything to do with that “interview” and immunity request to determine who came up with that travesty immunity idea. This is investigation 101 stuff not complex stuff. Fired? He should be put in a room with a mat and a knife. Better still ask him who forced this POS way to do the inquiry and if he stammers or his answer does not match the facts put a cage over his head and drop in a rat. If he talks consider removing it.
The only position Comey should have, along with other convicted Clinton Foundation people, is hanging on the gallows.
Impeach Obama IMMEDIATELY after the election so that he cannot issue pardons. Take your time so that they don’t vote on it. If the new congress takes office on Jan 3 we may have a problem. Just find a way to go after the Lieutenants without Obamas protection. Comey can resign before Dec. 31 if he has a sense of honor. Some on our side swear by it. Fine. Others can lawyer up and if found not guilty the taxpayer can and should pay their legal expenses.
