Delegates Remain Committed to Donald J. Trump; Anti-Trump Effort Dealt Crippling Blow
(New York) July 11, 2016 – Senior United States District Judge Robert E. Payne today ruled in favor of Trump campaign delegates who had argued – in line with overwhelming public opinion – that RNC delegates must follow election results and that delegates cannot be stolen at the national convention. Delegate Beau Correll, Jr., had brought the suit against the Commonwealth of Virginia hoping to reject the will of the voters, but was soundly defeated.
Specifically, the Court found that RNC Rule 16, which binds delegates based on their election results, “is in effect presently and that it controls the allocation and binding of delegates as to their voting at convention.” (p. 6) The Court held that the Plaintiff’s “expert testimony” from Erling ‘Curly’ Haugland was not credible, lacked “textual support,” (p.6) and that “delegates are bound by RNC Rule 16.” (p. 7)
Further, the Court found that by signing the “Declaration and Statement of Qualification,” RNC delegates are bound by RNC Rule 16(c)(2) (p. 10), and that this Declaration obligated Correll to vote in accordance with Republican Party rules and Virginia’s election results. (p. 46)
Trump Campaign Attorney and former FEC Chairman Don McGahn issued the following statement: "The court has confirmed what we have said all along: Rule 16 is in effect and thus delegates, including Correll, are bound to vote in accordance with the election results. The court did not buy what Curly Haugland was selling, and noted that his testimony has no support in the rule's text and was contradicted by his own book, Unbound. This case puts his unbound theory to rest, and is a fatal blow to the Anti-Trump agitators.”

Looks like Manafort has this firmly under control. Huckabee said that there will be hell to pay for going against Trump. Senators who go against them will regret it.
What he really got was the slate of delegates that was proposed by the Trump campaign at the state convention which was rejected on a floor vote. Only 8 delegates can vote for Cruz based upon this ruling and it is too late for any other kind of ruling to happen. I suspect the NT crowd will be dealt with like the Roach Paul crowd was dealt with in 2012.
The fact that this suit was brought is troubling in itself.
MSNBC was putting the BS spin on this this morning with Hallie Jackson pushing how the only thing that mattered was all about that Virginia delegate’s ruling.
I only caught the end of an interview with Sam Clovis, but he didn’t seem too clear on the issue.
Later, Paul Manafort on Fox and Friends was all smiles and, when asked what the theme of the Convention was going to be, he cheerfully replied “Make America Great Again!!”
At any rate, Trump wasted no time in posting this release on all his social media and campaign sites.
The delegate system is beyond stupid and beyond antiquated.
Count the votes.
Award the nomination to whoever gets the most votes.
Period.
End of story.
Those delegates who want to cheat are free to stay home and not go to the convention...
Sure, any delegate is free to vote for whoever they want, or not show up and vote at all....it just doesn't really matter as Rule 16 makes the floor vote just a ceremonial exercise. Rule 16 states that if a delegate votes contrary to the way they are bound or abstains for casting a vote, their vote or non-vote will be disregarded and they will have been "deemed" to have voted for the candidate they were pledged too. So essentially Trump has already won and the floor vote is simply a proforma function, as regardless of how the delegates actually vote on the floor, their votes will be recorded based on their state results. The only delegates exempt for Rule 16 are the unbound delegates...
I totally agree that nominations should be given to the winner of the most votes period!
However, I guess the Electoral College system acts as a safe guard. Otherwise, Mexifornia would wield undue influence!!

Between the “Summer of Chaos” and this delegate confusion, I don’t feel good about this convention at all.
With the exception of BLM, I have never seen a candidate’s supporters work as hard to undermine their own candidate as you guys do. It’s like watching the left burn down that black-owned bakery in Ferguson because they hate white people. They really showed us, huh?

My understanding is that the Republican Party reorganizes every four years at their convention. The first order of business is to adopt the rules that the Party will follow during the next four years. I don’t know of anything that would preclude them from adopting a new Rule that unbounds the delegates.
Of course, if they did that they would be writing the obituary of the Party, but the convention would have the power to do this. There will probably be some drama over this issue, but I expect that the rule will not change and therefore the delegates must vote as instructed for the first ballot.
I want delegate system with strictly apportioned delegate selection for both primary and general election. No super delegates, just fractional delegates. Carry this over to the general election and California gets neutered, except for the undue influence from the California liberal millionaire club’s money feeding Senate races across the country.
