Former attorney general: Trump right to question judge’s fairness

Former Attorney General Alberto Gonzales says Donald Trump is right to challenge the fairness a judge overseeing lawsuits against him.

“An independent judiciary is extremely important. But that value is not the only one in play here,” Gonzales wrote in a Saturday op-ed for The Washington Post.

"Equally important, if not more important from my perspective as a former judge and U.S. attorney general, is a litigant’s right to a fair trial,” he continued.

“The protection of that right is a primary reason why our Constitution provides for an independent judiciary. If judges and the trials over which they preside are not perceived as impartial, the public will quickly lose interest in the rule of law upon which our nation is based.” Trump on Thursday said U.S. District Judge Gonzalo Curiel’s Hispanic ethnicity is “an absolute conflict” in three civil fraud lawsuits against the billionaire.

He said Curiel’s “Mexican heritage” makes him partial because of Trump’s calls for a wall along America’s southern border with Mexico.

The question is whether this judges's strong identification with his ethnic group would bring bias into his sitting as judge in a case where the defendant has taken stances strongly opposed by Mexican activists and members of the organization the judge is associated with.

Trump has insisted that he is not against Mexican-Americans and expects to do very well with Mexican-American voters; he says he is only against illegal aliens. The judge was born in Indiana and spent most of his career prosecuting Mexican border-jumpers and drug smugglers. So where is the bias?

The judge has taken an oath to uphold the constitution
The judge is on a committee that award scholarships to ILLEGALS immigrants
La Raza who the judge has a relationship goal is to “return” American land to Mexico The law group he is a member of provides legal services to the undocumented
It appears the judges behavior is in conflict with the oath to uphold the constitution!
IMO he should be removed not only from the case but from the practice of law

It’s difficult to see Trump’s litigation strategy here. If Trump really thinks that being a Mexican, donation to Clinton and being an immigration advocate disqualifies a judge, he is wrong. If he thinks the judge is going to remove himself, or be removed, he doesn’t know the law. If he thinks that this will somehow make the judge rule his way, he’s a fool.

He knows damn well this entire "lawsuit" by NY AG Schneiderman -- and the selection of this La Raza judge -- is a scam and a fraud. "Litigation strategy" is irrelevant. the only thing to do is attack the entire system as corrupt and attack to destroy.

The judge is suspect in the leaks of the TRUMP case.

TRUMP has cause to change judges, and the Mexican LA RAZA nudge already should have refused himself. This is a set up.

You can read this and determine if you see any evidence that he might be biased against Trump and stances Trump has taken concerning illegal aliens and illegal entry at our southern border.

Active in the La Raza Lawyers of San Diego and active in working for the interests of the Hispanic community. On a selection board that awarded scholarships to Hispanics, recent arrivals and at least one of whom was "undocumented". Fine with him if illegals attend US universities. Sounds like something of an Hispanic activist.

La Raza Lawyers of San Diego told TheDC in a statement Wednesday. “We help empower Latino attorneys, judges and law students, and provide services to the greater local Latino community.”

No details on what those 'services" are. Probably needed.

Why is the legal group called LA RAZA in the first place since it means “THE RACE”? I would think that a group of educated lawyers would pick a less ethnocentric racist name just out of caution.

Point taken. It would be like an Indiana law group taking the name “ The Clan”. Then pointing out it’s with a C not a K.
Since the KKK had a strong historical footprint in the Indiana legal profession in the 1940-50 it would be assumed to be linked.

I see Fox is admitting, though minimizing, the la raza connection, while it pushes the “you shouldn’t question a judge based on race” meme.

I’m really impressed by how they’ve gotten Alberto Gonzalez to validate Trump’s concerns while still making it look like his problem is race.

Your link in #91 also lists voter registration as an activity of the La Raza Lawyers of SD. Who believes that is restricted to registration of US citizens?

And the links provided on the right hand side include MALDEF and the National Council of La Raza and an impressive lists of organizations, many of which aid illegal aliens and advocate open borders and no effective immigration law enforcement.

One could question whether this judge should even be a federal judge, let alone a judge hearing a trial involving Trump. He’s full bore associating with the identity politics organizations that advocate for Hispanics, and certainty don’t advocate strict enforcement of US law.

The judge is a racist. He is a member of La Raza. He has to be exposed for exactly what he is. He could have only been appointed by a racist democrat which he was because Obama appointed him.

Canon 2: A Judge Should Avoid Impropriety and the Appearance of Impropriety in all Activities
