Legally-armed citizen won't be prosecuted in fatal Mandeville shooting

A legally-armed citizen who fatally shot an attacker at a Mandeville convenience store in April will not be prosecuted, St. Tammany Parish District Attorney Warren Montgomry said Friday (May 27). Mandeville police investigators concluded Shawn Breland, 42, of Folsom, was the aggressor at the Shell gasoline station and convenience store at 3959 Louisiana 22.

"Although Mr. Breland's death is a tragedy, this office agrees that the shooting was legally justified under the circumstances and will not pursue criminal changes based on the evidence submitted to date," Montgomery said in a news release that included surveillance camera video of the incident. (See video above. Warning: graphic content).

Police Chief Rick Richard has said the customer was lawfully carrying the firearm on his side in plain view. "Louisiana is an open-carry state. The guy was straight-up legal," Richard said on the day of the shooting.

Neither police nor the district attorney's office has publicly identified the armed citizen. Breland died at Lakeview Regional Medical Center shortly after the 10 a.m. shooting on April 4.

The customer, carrying a holstered handgun on his side, fatally wounded Breland after Breland attacked him, police have said. They described Breland as "highly agitated" during the incident.

I noticed the shirt as well which is probably why I feel the way I do about the shooter.

When the van pulled up it looked as though there were several occupants in the car. The bum may have been with the guy that got shot.

In parts of Louisiana, you have to check the birth certificate to be sure. One woman was 48 before she found out she was black. https://www.washingtonpost.com/archive/politics/1983/05/21/louisiana-court-sees-no-shades-of-gray-in-womans-request/ddb0f1df-ba5d-4141-9aa0-6347e60ce52d/

He looked drunk to me. Liquid courage will only take you so far before the cops get you or you wind up dead.

The dates sure do make it sound like him. Maybe he was drunk and thinking about buddies he lost fighting rag heads. Pure speculation on my part.

The only thing I can see that is iffy is the shooter shot while the store owner was near him. That could’ve went bad quickly BUT I think at that point the shooter knew he was already at the “shoot” option of a “shoot/no-shoot” assessment. The attacker was clearly not in a stable frame of mind. The gun owner could’ve easily been bowled over and lost his weapon and then if the attacker had killed anyone it would’ve been on him.

He almost had to be fortified in some way. But it would be up to the coroner to figure out with what.

Important note to those that open carry guns: think of a 360 degree circle around you. If you stand still, from five or ten feet away, your gun can only be seen by someone from *part* of that circle, a given number of degrees. Otherwise it is hidden behind your body.

If a situation is starting to become tense, it is a good idea to angle your body so that your open carry is not immediately seen by the aggressor. And if you draw, even a lot of the draw may not be seen by them either.

Often you will not be the subject of the aggression, so it is also good to move so you are even less obvious to the aggressor, putting you in a much better position if you need to act.

Maybe you like armed citizens playing cops but I don't. As to my “armed chair assessment” I have witnessed and been involved in a number of situation like this and there has never been a shooting. Just observe and let the cops handle it.

I don't know where you live; it must be a wonderful place with lots of police and few nuts and criminals. I spent 25 years working with the police on a daily basis.

There are many times that a good citizen with a gun has saved the life of innocent people including themselves. It has nothing to do with a good citizen “playing cop”. Where we live cops are outnumbered by hundreds if not thousands to one. We often have just a few cops covering a huge part of the county. Depending on the situation it can be hours before they show up. Thank God for good citizens who are armed and willing to protect themselves and other good citizens. They are a major deterrent to crime in our area.

The gun club I belong to has the police range right next to it. We are behind two locked gates. The one we used is suppose to be closed after certain hours. The sheriff's department normally uses the other gate. I came in one time and locked our gate behind me. I didn't realize that the deputies were using our gate for some reason and none of them had the key to either.

After I finished my shooting and I went to leave, I found that there were a dozen deputies lined up in their cars waiting to leave. One of them told me that I had locked literally half the deputies on duty at that time in our part of the county in the shooting range. They were trying to find some bolt cutters when I unlocked the gate for them.

No, I well remember Ferguson and Baltimore from last year. And FL from GZ/St Skittles a few more years back.

I like it a whole lot better than you playing "grand jury," particularly when the shooter was exonerated by all the relevant authorities.

In fact, I find your Monday morning quarterbacking, contemptible.

Lots of light skinned blacks in Louisiana, descendants of plantation owners and slave mothers. Called “passé blanc” —passing for white.
Lighter than mulatto.
Many of these freed slaves actually owned slaves themselves, and it wasn’t unusual for them to own their own relatives as slaves.
These are the historical roots of self hatred and murderous infighting we see today. Blacks resent other blacks who succeed or “act white.”

The clerk did notice.

Seems pretty obvious to me the victim bought the bum a beer, and the clerk got pissy with him for encouraging a loiterer.

Victim got incensed over his “tolerance” and “SJW” creds being disrespected, and away we go....

Quadroons, octroons (most popular mistresses and prostitutes in New Orleans).

But if they could pass the bag test, it was probably best to send them up north to pass.

Now this is making more sense.

Victim was a member of “Patriot Guard Riders.” The bum he bought a beer for was probably a vet. Folsom might have been outraged by having another vet disrespected by a convenience store clerk.

He even makes a appeal of some sort to the shooter at one time while he’s bitching out the clerk.

The shooter showed exceptional restraint given the size and comportment of Folsom.

I didn’t know that, and now some of all their anger and hatred, makes sense.

Drawing a gun and getting a non-compliant response (”go ahead and shoot me!”) definitely makes things a lot more dangerous.

Well ya...for the guy you are going to shoot. One shouldn't draw unless prepared to shoot, a drawn weapon isn't meant to deescalate an encounter. That thought process (If I draw the gun the bad guy will run away) could be fatal.

Certainly, you must be prepared to shoot. But 95%+ of the time, they run away, or desescalate in some other fashion, according to John Lott.
