The Definitive Birther Smackdown
Conservative Review ^ | 04/16/16 | Steve Deace

Posted on 04/17/2016 5:57:25 PM PDT by writer33

There are several resident status classifications in the United States: natural born citizen, naturalized citizen, diplomatic immunity, temporary resident (on a visa), lawful permanent resident (green card holder), and illegal alien. Ted Cruz isn't the child of diplomats, and he was never naturalized as a citizen.

So either he is an illegal alien or a natural born citizen. There is no middle ground. If you don't believe he is a natural born citizen, then you believe there is an illegal alien serving in the U.S. Senate. There is no middle ground. You should immediately call for his deportation.

The Constitution gives explicit power to the Congress to determine citizenship and border enforcement. Since the Constitution never defines explicitly what natural born citizen means, that means beginning with the 1790 Naturalization Act Congress has been defining it — which the Constitution gives Congress the power to do.

If you believe both parents have to be natural born to be qualified to be president, then you actually believe Millard Fillmore was the first president and not George Washington. If you believe both parents have to be natural born to be qualified to be president, then Donald Trump is also ineligible because his mother was born in Scotland and became a naturalized citizen, just like Rafael Cruz.

Nice straw man.

The 14th Amendment makes it clear with "and subject to the jurisdiction thereof" that citizenship in America is determined by jurisdiction and not geography. This is how John McCain was a natural born citizen while being born in the Panama Canal Zone — his father was serving in the military under the jurisdiction of the U.S. government. Ditto for my wife born in then-West Germany while her father was in the 101st Airborne. Cruz's mother was a natural born citizen, therefore she was under the jurisdiction of the U.S. government when he was born in Canada. This makes Ted a natural born citizen, as at least three court cases in the past year have agreed as well as Congressional statute and all other judicial precedents.

Who believes both parents have to be “natural born citizens?” Most “birthers” who subscribe to Vattel believe both parents have to be citizens.

The GW reference is ignorant, since the Constitution at its adoption ‘grandfathered’ in those who were citizens at the time. None of the Founders or Framers could possibly have been citizens of the US at the time of their birth. Duh.

Real “definitive.”

So either he is an illegal alien or a natural born citizen.

Non sequitur. He could also be a naturalized citizen.

Once you've made such an obvious mistake, any credibility you might have had evaporates.

But both weren’t born in the U.S. This is a loser of an argument. It’s was shot down with Obama and it’ll be the same, but any party that wants to take it to court and lose, they certainly have the right to do so.

Your comment: “The author is an idiot.”

You are correct, but every once in a while, even idiots get the right answer.

The best discussion of this issue with an excellent argument for each side of this dispute can be found at the link below. In the end, Mr. Ramsey concludes that Mr. Cruz is eligible for the Office of President.

We’re still having this debate? We won it a long time ago here on FR. Last thing we need is some Freeper using Steve Deace, a complete ignoramus who doesn’t even understand the debate, to open his stupid fat mouth.
