The IRS is struggling to ensure that illegal immigrants are able to illegally use Social Security numbers for legitimate purposes, the agency's head told senators on Tuesday, without allowing the numbers to be used for "bad" reasons.
IRS Commissioner John Koskinen made the statement in response to a question from Sen. Dan Coats, R-Ind., during a session of the Senate Finance Committee about why the IRS appears to be collaborating with taxpayers who file tax returns using fraudulent information. Coats said that his staff had discovered the practice after looking into agency procedures.
"What we learned is that ... the IRS continues to process tax returns with false W-2 information and issue refunds as if they were routine tax returns, and say that's not really our job," Coats said. "We also learned the IRS ignores notifications from the Social Security Administration that a name does not match a Social Security number, and you use your own system to determine whether a number is valid."
Asked to explain those practices, Koskinen replied, "What happens in these situations is someone is using a Social Security number to get a job, but they're filing their tax return with their [taxpayer identification number]." What that means, he said, is that "they are undocumented aliens … . They're paying taxes. It's in everybody's interest to have them pay the taxes they owe."

Most SSN used by illegals are those of family members. You may be surprised how many babies and 8 year olds are doing construction. When not family members, it is often a rented SSN of a friend who is out of work (housewife, unemployment comp, etc).
The pattern differs for skilled workers (eg IT). Satyam style consulting firms will assign the same SSN to many different consultants. So a consultant at Allstate, Sears, BMO, State Farm, Caterpillar might each be using the same SSN. Rarely will you find an unskilled temp agency doing that.

Often, the victims of this identity theft are honest and hard working Americans with Hispanic surnames.
They find out about it when they file for a tax refund and get a letter from the IRS saying IRS had sent a refund to them at an address, where they didn’t live.
I’m sure the GOPe is hard at work on another strongly-worded letter, condemning Trump for being a bigot!

So one of my partners, a tax lawyer, says the spin on this story is all wrong. He says the IRS is withholding $$ with respect to the SSN but ... because it is fraudulent use of the SSN, there’s no matching returned filed. Ergo, no one ever comes back to claim those funds the IRS holds. He thinks the IRS collects billions $$ of this and thus doesn’t have any incentive to stop it (and further than DC knows this and doesn’t want to stop the revenue stream either). Does that make sense to you?
