The statute requires proof of three elements: (1) an intentional, unlawful threat; (2) an apparent ability to carry out the threat; and (3) creation of a well-founded fear that the violence is imminent. So there is a question of course of Lewandowski's supposed intent, as evidenced by his act of pulling her out of the way. But the real kicker is whether a reasonable person under such circumstances -- a reporter in the crush of a crowd of reporters surrounding a candidate guided by security trying to push through that crowd -- would have been afraid of imminent violence.

Other stills and video show Cory leaning over and stretching out to grab her. This video snippet comes after, when Cory has straightened up. The problem with that is that it cuts in at a point after the initial contact. Given a few seconds more, this video could be fairly conclusive one way or the other. Why does the video cut in at exactly the point it does? Did they not have a few more seconds of video more that captured the lead up to and the initial point of contact? Or is it edited to make it seem when Cory goes by it is the initial point of contact. It can be like the cameras in the NFL where from one angle the guy is out of bounds but from another he is in, or from one angle it is a catch but from another it is not. Every picture and video needs to be compiled and looked at all together before the the called is made.
This video is from a different time than the surveillance video. In the surveillance video there is a guy wearing maroon pants and a maroon and white checkered shirt, right next to Lewandowski and Fields. He is not in the new video. Instead, there’s a guy in a suit where he was in the surveillance video. Also, in the new video, there is a wall not too far behind Lewandowski and Fields. There is no wall in the surveillance video, which gives a much wider view.
I’m sure it was recorded afterwards. I wonder if an expert could look at the phone and tell when it was recorded. Of course, I’m sure she’s erased it by now.
