Former CIA Chief Says Military Could Defy Donald Trumps Orders

WASHINGTON Retired Gen. Michael Hayden, who recently led the National Security Agency and the Central Intelligence Agency, said the U.S. military would likely refuse to follow certain orders from Donald Trump if he is elected to the White House in November and follows through on campaign promises.
"I would be incredibly concerned if a President Trump governed in a way that was consistent with the language that Candidate Trump expressed during the campaign," Gen. Hayden said during an interview will Bill Maher on Friday.
Mr. Trump, the frontrunner in the GOP primary, has vowed to use torture techniques against suspected terrorists if he wins the White House, going beyond waterboarding and doing things he described as a "hell of a lot worse."
He has also suggested he would order U.S. forces to kill the family members of terrorists, a charge that some have alleged would be in violation of the Geneva Convention.

Yes, and as someone else (maybe you?) said, Congress can change what is or isn’t legal. And if Obama’s invaders start chaos here a POTUS can use martial law also, if the need is there. With a POTUS who would back up the CIA rather than stab the whole system in the back, things could be a lot different than they are now. But I think a lot would depend on whether Trump would be willing to clean the CIA and military house, as others have also mentioned. There is one whole side of the CIA that engages in treason against the USA. Will Trump get rid of them? Same thing with NSA. Will Trump excise the stuff that wages war against the American people and only keep the stuff that is necessary to protect us?
It’s an important question. I remember thinking under GW the Patriot Act was necessary - mostly because I thought that GW would not use these powers against the US public. And as far as I know, he didn’t. But having the PERMISSION to use them against even law-abiding US citizens was a bad, bad, bad thing to have in place for a lawless foreign enemy combatant like Obama. So now what would Trump do? Would he seek to gather even more power for the POTUS, thinking he would use it benevolently? Or would he try to get things back to a lawful balance?

If Trump is elected he should direct his Justice Dept to investigate Haydens illegal domestic spying at the NSA and his bald faced lie to congress.

I agree he should find a way, but I don’t think an executive order would be necessary.
This law was added to a bill run by a GOP congress. The next GOP congress can write another one. They’ll do it when it’s needed. Enough Democrats will go along when given the right incentive. Democrats went along with waterboarding before, and they can go along with it again.
It doesn’t have to be waterboarding. They can find another method, or they can just call it something else.

The Geneva Convention specifies that uniformed combatants are subject and non-uniformed are excepted from any rules. They could and should be shot on sight, but nothing is off limits!
