The 1790 Naturalization Act was repealed in 1795.

John Jay’s children would have been exempted by the same exemption as all the founders, that part after the comma, “or a citizen at the time of...”

The Harvard Law Review wants the Constitution changed without changing the Constitution, just like both parties that cooperated to obfuscate for The Usurper.

I believe they are both ineligible but, a tit for tat given the “so called history” of the current POTUS amd Cruz’s deep conservative values, then KcuF it.

I’ll still vote for Cruz.

Rubio is easy to pick off as his parents weren’t naturalized until well after his birth.

Indeed, because his father had also been resident in the United States, Senator Cruz would have been a "natural born Citizen" even under the Naturalization Act of 1790.

How can that be, since Ted Cruz's father was not a US citizen until 2005.
Prior to that the father was a Canadian citizen as was his son Ted until 2014?

Did I miss an amendment to the Constitution changing the earlier rules on Natural born.? -Tom

Canada’s laws have no bearing on US law. Our laws are independent of any other country.

Cruz father was given political asylum by the US. Cruz father left Cuba in 1957 to attend the University of Texas at Austin and obtained political asylum in the United States after his four-year student visa expired.

It doesn't. Having been on birther threads in 2008 we discovered that US law doesn't care what another country says.

Okay, so US law doesn’t speak to dual citizenship as regards to President qualifications.
I know Cruz took the steps to relinquish his Canadain citizenship.

Unfortunately, the legal arguments are not as important in this situation as the political make-up of the appeals court and now the Supreme Court. All Trump has to do is file at the most opportune time, and in the most opportune location and on appeal Cruz’s fate will be in the hands of three federal judges, two of whom will likely be liberal Obama appointees. With the current make-up of the Supreme Court their decision will stand.
