The question of whether or not Ted Cruz can serve as president of the United States is heading to court.

A judge has agreed to hear a lawsuit filed against the presidential hopeful by Illinois voter Lawrence Joyce.

CNN reports that the case will be heard in Cook County Circuit Court in Chicago on Friday in response to Joyce's claim that Cruz should not appear on the ballot for next month's Illinois primary because he was born in Canada.

Cruz has stated before that he is an American citizen despite being born in Canada and having a Cuban father because his mother is American.

Won't happen. If they are not dismissed due to lack of standing on part of the plaintiff, one case will proceed, be fast tracked, and will become the precedent for all the others.

It's only a nuisance case.

There is no such law granting natural born citizenship to the child of a U.S. citizen mother. Ted Cruz is not a natural born citizen of the United States. Ted Cruz is also not a lawful U.S. citizen, unless he naturalized as a U.S. citizen while he was an alien Canadian citizen. If Ted Cruz did not naturalize as a U.S. citizen, he is not a U.S. citizen and his service as a U.S. Senator is illegal.

Honestly, I’ll take Cruz’s scholarship on this issue over any lawyer Trump can hire, any day of the week. Goes double for the ambulance chaser or Grenada law school graduate that this guy has probably hired to represent his case before the court.

But Cruz is a ‘natural born’ Canadian... NOT a ‘natural born’ US citizen... It takes two US citizen parents to give birth to their child on US soil to be a ‘natural born’ US citizen...

It would be so simple if Cruz showed his papers, other than his Canadian birth certificate.... That Canadian birth certificate sure will not get one a US passport... so how does Cruz have a US passport?

Whether or not a Federal court chooses to recognize the fact, Ted Cruz did not acquire U.S. citizenship of any kind at birth according to the U.S. Immigration and Naturalization Act of 1952. See:

66 Stat. Public Law 414 - June 27, 1952
CHILD BORN OUTSIDE OF THE UNITED STATES OF ONE ALIEN AND ONE CITIZEN PARENT AT TIME OF BIRTH; CONDITIONS UNDER WHICH CITIZENSHIP AUTOMATICALLY ACQUIRED

Sec. 320. (a) A child born outside of the United States, one of whose parents at the time of the child’s birth was an alien and the other of whose parents then was and never thereafter ceased to be a citizen of the United States, shall, if such alien parent is naturalized, become a citizen of the United States, when -
(1) such naturalization takes place while such child is under the age of sixteen years; and
(2) such child is residing in the United States pursuant to a lawful admission for permanent residence at the time of naturalization or thereafter and begins to reside permanently in the United States while under the age of sixteen years.

Ted Cruz was born outside of the United States in Calgary, Alberta, Canada. His father at the time of birth of Ted Cruz on 22 December 1970 was an alien in relation to the United States, having Cuban citizenship and Canadian Permanent Resident status on the path to Canadian citizenship afterwards. Ted Cruz attained the age of sixteen years on 22 December 1986, at which time his alien father was a Canadian citizen and was not naturalized as a U.S. citizen. Accordingly, Ted Cruz did not meet the conditions necessary to “become a citizen of the United States” as required by Public Law 414 Section 320 CHILD BORN OUTSIDE OF THE UNITED STATES OF ONE ALIEN AND ONE CITIZEN PARENT AT TIME OF BIRTH; CONDITIONS UNDER WHICH CITIZENSHIP AUTOMATICALLY ACQUIRED

But, have fun with that. I won't play the game, and 847 posts won't change the eventual legal judgment ruling Cruz eligible, should any of these cases get through the court system, which is highly doubtful.

In other words, you could care less what the actual quoted law has to say on the matter. So, why should anyone listen to anything further you have to say on the subject or other subjects when you show such contempt for the literal words of the law?

That might be credible if he hadn’t raised tens of millions of dollars. An obviously naturalized citizen defrauding donors is mail fraud and wire fraud.

He’s made a terrible mistake and is trying to bluff his way through it. He’s only making things worse for himself.

Didn't say Cruz was my candidate. I spent a couple of hours researching it, this stuff has been floated around the net every since THE DONALD decided Cruz was a threat, and I'm completely satisfied that Cruz is a NBC under Constitutional law. I've also seen you repost and repost and repost, and you know, NOT A SINGLE FREEPER is going to abandon his or her candidate because they agree with your posts.

I'm just tired of FREEPERS using FR as a running Trump campaign commercial, hijacking threads with irrelevant posts, spamming re-posts, and giving other FREEPERs that special "Donald" treatment with personal attacks.

So, you enjoy your game now. It won't get your candidate elected. The only people it helps will be the progressive Democrats, who will beat the THE DONALD, or which ever hollowed out conservative candidate manages to outlast him, because of THE DONALD's trash war on conservatives.

I'd like to support Trump, I'm looking for reasons why, but he's and his supporters are trying REAL hard to alienate me from the whole election process. I'm not lying when I say I was for Trump before I was against him, and I might support him as the GOP candidate in November. However, he's got a lot to prove before he earns my vote.

If Trump succeeds in alienating conservatives that on a wide scale, who benefits? (Hint: The same politicians who Trump has given most of his political money to over the past 30 years.)

No telling how this will end up, but there's no way this can get adjudicated before the convention -- it might screw up the primaries, too, if voters start second-guessing.

Actually, Trump tilted over to the GOP about 12-15 years ago. He's given lopsidedly to GOP candidates and causes, with a few exceptions (mostly in NYC) in the last 10 years or so. Someone posted up the data in another thread.

He used to donate about 6:1 'Rat, 25 years ago, but that's almost reversed the last few years.

FYI.

(Truth in advocacy, I'm a Cruz supporter, but would accept Trump (like a lit road flare) if he won the nom.
