The GOP needs to be proactive on this or they will lose the primary imperative. If you suggest something first it will stick in the public’s mind. Suggest we immediately identify an Italian-American federal judge with conservative pedigree that absolutely needs to be named to the bench.

We won’t go to jail if he doesn’t appoint someone.

He can appoint anyone he wants. He could do it today. He could have done it Saturday.

There is no time table in the Constitution. The Senate can choose to act. Or not.

I expect him to start off next week with an appointment. I don’t think Obama is so cold as to do it before Scalia is buried.

Accept his nominee for advice and consent. Slooooooow walk the process. Conduct lengthy public hearings. Vote "no" on his nominee.

The simple answer is that Obama can do what the constitution says he can do. He can nominate.

The Senate gets to advise and consent, but it looks like Obama isn’t taking anyone’s advice on whom to nominate.

The Senate can consent or not consent. They should non-consent on anyone who is not a jurist in the tradition of Antonin Scalia.

They, too, are doing their constitutional job just as it’s written in the Constitution.

Nothing is written that says they must approve a nominee. History is littered with nominees who have been disapproved.

The pitcher has to pitch the ball. The umpire has to call the balls and strikes. Just because he pitches the ball does not mean he gets a strike.
