"At the end of the day, the legal issue is quite straightforward," Cruz said calmly. "But I would note that the birther theories that Donald has been relying on, some of the more extreme ones insist that you must not only be born on U.S. soil, but have two parents born on U.S. soil. Under that theory, not only would I be disqualified, Marco Rubio would be disqualified, Bobby Jindal would be disqualified and, interestingly enough, Donald J. Trump would be disqualified."

Being absurd is a sure fire defense alright Ted.

I’d like to know if anyone at all on this forum, at 43 years of age didn’t know they were a citizen of a nation other than the U. S.

I don’t particularly think Ted is ineligible, but I do find some parts of this particularly annoying.

> Since the entire eligibility issue for Ted Cruz hinges on his mother’s status as a natural-born citizen

Hahahaha. More false framing.

I guess Ted Zeppelin forgot about 1000’s of New Yawk Snowbirds down Florida way and various NY Jews scattered around the 57 states.

No problem, Trump will take those votes gladly.

Where is such a theory found as opposed to the concept of both parents being citizens at time of birth? Just curious.

Dishonesty on Cruz’s part. He knows what the Constitution and 6 USSC cases says here and it does not require both parents of a candidate be Natural Born citizens, they only need to be citizens Legally created or otherwise at the time of his birth.

Baloney. Both of Trumps parents were US citizens. There is no requirement in the constitution for a natural born citizen (like Trump) to have natural born parents. Cruz was just throwing a smoke bomb here.

Frederick Christ Trump 1905–1999
Birth 11 OCT 1905 • Woodhaven, Queens, New York, USA

Donald Trump’s father was a United States Citizen by birth. As Lawrence Tribe says, the original intent argument for Natural Born Citizen says citizenship descends from the father. Therefore, Donald Trump is a Natural Born Citizen, even if he had been born abroad.

As Lawrence Tribe says, Ted Cruz is a Natural Born Citizen only if you adopt the “living” Constitution that says the evil, sexist founders should have included decent from the mother.

So Ted Cruz is a Natural Born Citizen only if Ted Cruz is not a original-intent Conservative! That was Lawrence Tribe’s argument as well.

Now you can be as emotional as you want about this, but these are the facts of Ted Cruz’s “birther” problem: He is either ineligible and a Real Conservative, or he is eligible and a Sometime Liberal.

Cruz just gets dumber and dumber. Now he is flat out lying about what any description of natural born citizen is.

How can people support him? I don’t see one shred of integrity in that man.

Ted Cruz is wrong.

The Vattel test for a’natural born citizen’ in the ‘Law of Nations’ (arguably the strictest test considered) is to be born in the US and of citizen parents.

The parents do not need to be ‘natural born citizens’ just citizens.

His mom was a citizen as she was naturalized and acquired US citizenship 4 or 5 year before Trumps birth.

Ted Cruz was just making stuff up.

Ted should leave that alone. Trump’s mother and father were both US citizens when he was born in the US.

Cruz’s mother was a US citizen, his father not a US citizen, when Ted was born - in Canada.

Cruz is doing well with a bad hand, muddying the waters. But a lot of people don’t want a foreign born to be president. He would best stop talking about this issue. No one is filing lawsuits over Trump.

Non-issue, however cynical on there part of Senator Cruz.

She was naturalized four years before Mr. Trump was born. Mr. Trump was born of two US Citizens.

Thanks Isara for being you. This makes Senator Cruz's remarks in the debate even the more questionable.

"Donald Trump is a natural born American citizen, above the age of 35 and a resident of the United States of America longer than 14 years," declares Birthers.org. "He has provided sufficient documentation attesting to his place of birth, and upon research of his parents it is determined that they were both American citizens at the time of his birth. ... There is no doubt that at his birth his natural allegiance for the United States of America was and still is unalienable. ... Congratulations Donald, you are the first prospective presidential candidate to qualify as a natural born citizen."

With seven years of birther controversy discussed here on Free Republic, I never heard anyone say that natural born means you are born of two natural born citizens. Trump quoted Laurence Tribe for his position; Cruz quoted “Some say”.

It was always of born of two citizens, of which Trump was certainly born to.

This was a weaselly, lawyerly deflection by Cruz, and it did not work.

Even if it were true, Trump was born in America which Cruz was not.

Trump was born with one claim on his citizenship.

Cruz was born with three.

For a Constitutional expert, he muddied the waters for the sole purpose of deflecting from his own position.

Trump is correct, that Cruz’s eligibility will need to be sorted out, and the sooner the better.

Fwiw.

Woodrow Wilson the 28th president had an American born father. His mother Jessie Woodrow was born in Carlisle, England. Some objections even then were raised as to the eligibility of Woodrow Wilson.

It was then established that on February 10th 1855. Congress had passed an act of derivative citizenship. (10 stat.604 section e). This meant that on marriage to an American citizen, his mother was then a citizen. He was born after this marriage.

Trump can breath easy.
