Taking away a constitutional right without due process should not make it past the first judge.

IIRC, Clinton signed an executive granting environmental groups immunity from suit. Something like that — I bet you know for sure. It came to mind after seeing your comment here about doctor’s being liable. Perhaps something?

The Fedgov has installed itself as the masters of the people instead of the servants of the public.

HIPAA does not assure your PHI data confidentiality.

1. HIPAA does not protect your personal health information from being disseminated by 8000+ different Healthcare entities.

Sharing YOUR patient Healthcare records is a 2+ Billion dollar a year business.

Data brokers share every detail about patients without rigorous requirement to ensure patient data identity anonymization.

See Harvard ’ s: thedatamap.org for details.

2. Oboma signed an Exec Order in Sept 2015 to create an interagency Behavioral Database Stazi dossier of all citizens.

(To better serve us, of course).

https://www.whitehouse.gov/the-press-office/2015/09/15/executive-order-using-behavioral-science-insights-better-serve-american

3. All Internet service providers, cellphone companies, Silicon valley app corporations provide user records to federal government law enforcement, security intelligence agencies.

FReepers will be in good company on the flashbang SWAT RED list

Obamacare became law without one Republican vote. It was done in budget reconciliation, the only trick they would come up with to get it passed. This is a real scary thing. Empowering doctors to report anybody they think is mentally ill to the FBI?

If one gets reported to the FBI where and how do you go to appeal to get your Constitutional rights and maybe even your personal property back which were taken without legal judicial review much less a jury trial?

Isn't this the very definition of a "Bill of Attainder"?...

Bill of Attainder Definition: A legislative act that singles out an individual or group for punishment without a trial.

The Constitution of the United States, Article I, Section 9, paragraph 3 provides that: "No Bill of Attainder" or ex post facto Law will be passed."

Gun control was "baked in the cake" with Obamacare.

"And, lo and behold, that's what I remembered. That's what we found with a scan of RushLimbaugh.com three years ago. So now, today, Obama is allowing and even demanding that doctors report mentally ill patients to the FBI. You know this is a common tactic in communist and totalitarian countries. It was famously used in the Soviet Union. It's still used in Cuba, and it is used in communist China.

"The way it works is, anybody that disagrees with the regime is labeled mentally ill or can be labeled mentally ill if they express a point of view that objects to the ruling government's point of view. "I'll give you a great example. .... That would be climate change."

Clinton, William Jefferson; Executive Order 12986 dated 1/19/96. URL: http://www.epa.gov/docs/fedrgstr/EPA-GENERAL/1996/January/Day-22/pr-765.html.

Selective indemnification like this is IMO a serious violation of 14th Amendment equal protection.

Doctors can report some mentally ill patients to FBI under new gun control rule
Politico ^ | January 4th, 2016 | By David Pittman
"Current law allows HIPAA exclusions for law enforcement purposes, but it's a broad exclusion."

Analysis of Obama's Executive Orders on guns (VCDL analysis)
Virginia Citizens Defense League VA ALERT ^ | 1-5-15 | Philip VanCleave
"11. Change HIPAA laws to allow states to share 'certain' information from a person's health records. Net effect: this is DANGEROUS, as it can strip people of the right to own a gun WITHOUT DUE PROCESS. No cookie cutter, bureaucratically controlled, examination of a person's medical records should be used to strip someone of any of their rights without DUE PROCESS!

See what was done to Dr. Emerson, by the way. Many have been denied and/or federally incarcerated without due process since then.

The Emerson Case

The case went all the way to the Supreme Court's refusal to deal with it, thereby supporting the unconstitutional case against Dr. Emerson. But very few political folks wanted to bother with it because of assumptions about separations and divorces. That's how they'll violate the Second Amendment against all, one very large group of Americans at a time. It won't take long.

I am also a physician. More troubling than having doctors report certain patients to the FBI, is the fact that the federal government now has access to everyone’s medical records. They can search all records for key words like Xanax, Risperdal, Methadone, Percocet, etc. and then investigate the individuals and/or the doctors.

There might be one way to deal with it. The EO will cause many to have a reasonable fear against going to doctors. Some family members of a deceased relative might try litigating based on that, but much publicity extra support would also be needed (maybe including Congress).

Exactly.

The right way to handle people suspected to be dangerous mental cases is to have someone who is really close to them to bring charges which would be heard by a judge.

With competent representation for the defendant.

What makes all of this so difficult, and beyond a simple executive order, is that in almost every single mass shooting, the first thing you hear is all of those close to the shooter on TV telling allfor the world to hear, “He was such a nice boy. I never dreamed he would ot something like this”.

So simple solutions will not fix it.

What we really need is some way to find out who has bombs under their bed, plans drawn up, etc. That would reduce the number of these incidents.

But the truth is that there are no perfect solutions that result in zero incidents.

“Better ten guilty go free than one man be falsely imprisoned” will forever be a valid and decent principle.

Anyway, thanks for verifying my sketchy memory. What’s kept Zero from doing the same for his doctor-snitches? Do you suppose it’s buried in the EO? Or does he hate that much anyones who actually stand by their oaths and try to save lives?

Well gosh, maybe then you can go look for it yourself if you want it so badly, instead of sitting and whining expecting others to do it for you.

I seem to remember something about that...

[... from years ago...]

Psychiatric Manual DSM-IV-TR Labels free Thinkers, non conformers as Mentally Ill or ODD
http://www.freerepublic.com/focus/f-news/2611730/posts
It is now confirmed by USWGO News that the DSM-IV-TR Manuallabels free thinkers, non conformers, civil disobedient advocates, those that question authority, and people considered hostile toward the government (aka Oath keepers and local militias) as mentally ill with the illness titled ‘oppositional defiant disorder’ or ODD. [snip]

So, if you are a small-government citizen, you are too ‘mentally ill’ to own a gun.

Lock up the crazy people. It’s no more of a “denial of liberty” than prohibiting unconvicted ‘person suspected of having mental issues’ from owning guns.

Didn’t the Sandy Hook shooter’s shrink have foreknowledge of this attack? Or am I confusing it with another case in California or Colorado?
