Krister Evertson is the type of person we all strive to be: Eagle Scout, National Honor Society member, worker with the deaf and hearing impaired, and all-around law-abiding citizen.
Krister sold raw sodium, which is perfectly legal and used in variety of applications. Raw sodium must be shipped by ground transportation, not through the air. Unbeknownst to Krister, even when he checked off "ground" on the shipping label, UPS may ship by air.
Krister was arrested at gunpoint. He was found not guilty, but the government wouldn't stop there. After spending $430,000 in tax dollars, the government subsequently tried and convicted Krister for abandoning the "toxic" materials he clearly and carefully stored under another's supervision. Krister spent nearly two years in federal prison.
Krister's story is no far-fetched exception to some arcane law. Thousands of law-abiding citizens have been convicted under the more than 300,000 federal provisions, most of them administrative -- in other words not passed by Congress -- that carry a criminal penalty.

On the other hand, any Article V effort could potentially precipitate the hot kind. It would be important to be aware of the possibility.

Per this EPA press release, he was dealing with 10 tons of sodium, and they claim he stored it improperly.
I don’t know any more than that...but the original article gave me the impression he just mailed one box of sodium. Seems like he tried a business venture that didn’t pan out, and didn’t have the means to store the unused sodium to the EPA’s liking.
I sprinkle it on my cereal every morning.
I use it to clean engine blocks that fail on dyno and etch the aluminum. I’m sure its not pure sodium and I am no chemist but some type of mixture added to water in a tank that has the word sodium in it.
I add the mixture in very small amounts to the water... veeeerrry slowly... like 1/2 cup at a time in 10,000 gallons of water and still get a reaction.
No he went to jail for shipping the sodium via air. Would you want your family on an aircraft that was transporting sodium? BTW he needs to sue UPS if indeed the packages were labeled correctly. EPA and DOT rules and regulations make it the shipper’s responsibility to insure no violations occur but UPS seems to be at fault if they didn’t inform him that aircraft would be used in “ground” shipments. If an Article V convention-caused revolution occurred I suspect freedom would have the winning team.
What it boils down to is that we are ALL criminals, the only distinction is between indicted and UNindicted criminals. There is NO possible way to live in the USA today without breaking the law and I would say breaking it on a daily basis. In addition you may be thrown in jail for some trumped up charge that really is not a violation of any law. This is a dangerous situation and growing worse daily. The only thing preventing a blowup is that so many people don’t seem to realize just how bad the situation is. There are a lot of people who are considered pillars of their communities and rightfully so who would be astounded to learn that they break the law on a regular basis without any knowledge of the fact. To listen to the rhetoric coming from left and right it seems that a lot of our supposed “leaders” have no interest whatsoever in correcting this problem, preferring instead to think up more reasons to throw people in prison.
If it's OK with everyone here, I'm going to wait a couple of years and then check back in on this thread after all the facts come out.
No, but I wouldn't ship my family via UPS, which is the only way they'd end up on a UPS flight.
The only response that I can come up with right now is, “ Before you point out the speck in your neighbor’s eye, remove the log in yours.” I can’t fault no one but me. On the bright side, my question was answered.

The defendant may be a smart guy of good character, but he sure used awful judgement in walking away from 10 Tons of Sodium he was responsible for, which is how Superfund sites occur. Storing 10 tons of Sodium is a Huge problem for a property owner, and an even bigger problem for fire fighters if it caught fire.
Can you imagine the explosive carnage that would have resulted from firefighters putting out a sodium fire with water?

Even if found completely innocent of everything ( he was the second time) the process itself is punishment both emotional and financial.

Their religion created so many administrative laws that it became impossible to follow all of them. They sought the Messiah to relieve them of the onerous laws imposed by their religion. Most Hebrews accepted the Messiah and his two commandments when he arrived.

very dangerous. so dangerous that in high school, my teacher gathered the class around a table for a demonstration. A pea sized piece was placed in a bowl of water and we watched it smoke, bubble and spin burning. somehow, we survived. Afterwards, he put the rest of the jar away in a cabinet in the classroom.
