Well, most such cases are state court matters and the president can’t force a state prosecutor to file for the death penalty. I appreciate the sentiment though.

I don’t think Trump understands the overwhelming majority of such cases are handled by state courts (over which the president has zero control).

There are already FEDERAL guidelines for the punishment of state crimes. Ever heard of 3 strikes laws? Minimum sentencing laws? those are all FEDERAL mandates on the penalties that can be imposed on STATE prosecutions.

Rarely can you tell whether a new Trump policy idea was gamed out beforehand or just something he came up with on the fly

I'll answer this. The guy has been in business for about 50 years. During that time he made is billions by being a good negotiator. A good negotiator is like a good poker player, they are aware of everything they do and say. He is not communicating anything he doesn't intend to communicate that is not part of a longer strategy.

Listen to what he actually said. He was going to issue “a strong statement.” Strong statements are made by leaders, but they are not mandates and they are not law and they are not violations of the constitution. Nothing wrong with a president urging the death penalty for convicted murderers.

Crimes should be tried and sentenced at the level which they occured. Kill a local police officer, get tried at the local level. Kill a state police officer, get tried at the state level.

Trying to nationalize every crime so as to appear "tough on crime" or "supporting our police officers" is a bad idea that leads to more harm than good.

The Donald does not seem to understand our Constitutional republic. The federal government has no say over whether a state applies the death penalty for any particular crime (unless it is an 8th Amendment issue). So as president, Trump could not impose a death penalty for cop killers. Even if they were federal cops or the cops were killed on federal land, the most a Trump administration could do is seek the death penalty - a court has to sentence someone to death after the trial.

This is another case where Trump is saying what people want to hear, without anyone realizing that he has no way to actually follow through...

once again this is just people in the media paraphrasing INCORRECTLY what was said and ppl jumping to incorrect conclusions. Kinda like when Trump said he was goign to ban muslims...CUT...leaving out muslims immigrants. Making everyone incorrectly drawing the conclusion that he mean American muslims

I like Trump, his shocking revelation that maybe we should stop importing terrorists as fast as humanly possible has won me over to his side. But, this just feels like he’s throwing stuff at the wall to see what sticks. In any state that actually has the death penalty, killing a cop puts you at the head of the line anyway.

As to whether he can actually do what he says: Sure, there are federal guidelines, but are we really saying he can make the death penalty a federal guideline? Maybe, I don’t know. We can say he SHOULDN’T be able to but Obama has redefined what a president can and can’t do. One of the arguments for (or against) Trump is that people perceive him as being likely to use all the power Obama has invented for the office of president.
