There are already FEDERAL guidelines for the punishment of state crimes. Ever heard of 3 strikes laws? Minimum sentencing laws? those are all FEDERAL mandates on the penalties that can be imposed on STATE prosecutions.

There is a Federal 3 strikes law that applies in Federal prosecutions, but does not apply in state prosecutions. Some states (roughly half, I believe) have enacted their own 3 strikes laws, but that is not required by Federal law.
And, there are Federal mandatory minimum sentences for some crimes, but that too only applies in Federal prosecutions, not state prosecutions. Again, many states have enacted their own mandatory minimums for some crimes, but they were not required to do so by Federal law.

If what you say is true, the every state would have a 3-strikes law, and all states would have the same minimum sentencing rules. The only thing the Feds can control is federal cases.

Some states have 3-strikes laws, some don't.
