A federal judge has chosen for now not to force Texas health officials to change their stance in denying birth certificates to immigrant families with U.S- born children, saying that the families raised "grave concerns" but more evidence is needed, according to a ruling issued Friday.
U.S. District Judge Robert Pitman in Austin denied an emergency injunction on behalf of immigrant families seeking birth certificates for their children after the Department of State Health Services refused to recognize as valid certain forms of identification.
The families' lawyers had asked for the judge to intervene, saying that the children's right to health care, travel, and schooling--along with parental rights--are being harmed.
Pitman called the arguments of the families "heartfelt, compelling and persuasive," but said that this was "not enough without substantiating evidence to carry the burden necessary to grant relief," according to the ruling.

No. Not “immigrants”. My grandparents from Italy were “immigrants”
The law that made children born on American soil citizens was done for the former slaves’ children, not for illegals to dump a kid here.
Two illegals crossing the border and having a kid shouldn’t get birth certificates.
It’s so easy to understand.
Excellent. So some judges aren’t totally brain dead. Amazing.
He may still go south though.
At least he didn’t snap to attention at once for the illegals.
trump.......effect.???
Ted Cruz and elected US Senator Is FROM Texas....ya dont suppose that the OTHER good people in Texas had a Little to do with this?
“Hey Margie were gonna get some RAIN.”
“MUST be the TRUMP EFFECT Luther...”
PLEASE
GO TRUMP!!!
Except that's not the issue in this lawsuit. Texas admits that children born in Texas are U.S. citizens. It is refusing to issue birth certificates to the parents because the parents do not have sufficient I.D. to prove that they are, in fact, the parents of these children. The only issue in the lawsuit is what kind of papers the parents need to prove their relationship with the children.
and when ya get there....... STAY THERE!
Thanks for setting me straight. That sounds even more cut and dry.
Barry Soetoro and his ‘RATS are going to throw a tantrum over this.
Sounds like the commie ‘RATS have convinced the illegal alien invader freeloaders that healthcare is a “right”. I’m still waiting for someone to prove that myth. If it’s a “right”, why are doctors and hospitals being allowed to charge for it?
:)
By statute-- not the Constitution-- anyone present in the U.S. has a right to emergency medical treatment (not other healthcare).
If the consulates can issue these "matriculas consulares" for the illegal alien parents, they can also issue birth certificates for the illegal alien babies spawned by the same parents -- because the babies are citizens of their parents' native country.
ALL credit goes to the people of Texas and their State government.
Kudos TO Texas!
XOXOXOXOXOXO TRUMP!
I am so glad that the people of Texas are flexing their muscles. The Dallas Parkland Hospital has been allowing 1,000 illegal alien women to give birth there every month. What an outrage. What a bunch of thieves.
No more LADRONES!
“This is good! Trump effect!”
No, it was many months ago, before any candidates had announced for president, that these birth certificates would not be issued by Texas, due to the parents not having identification as to who they were. They could say they were Bob and Rosy Smith but couldn’t prove that with any proper identification. Texas will not issue a child a birth certificate without knowing who the parents are.
