They don't have to. As another thread pointed out, her statement was, "None of my emails were marked as classified." And they weren't.

Someone stripped off the classification before they sent it to her. And while I am sure she knew that - and even directed it to happen and is therefore guilty of conspiracy - she wasn't the one breaking the law. They won't, of course, be able to prove the conspiracy unless one of her co-criminals confesses, and they won't.

My only hope is that this costs her the nomination - not because she is found guilty. They are way too good at stalling for that to happen before the election. But because (Note: This is a hope, not a promise.) people may realize how wrong it was for her to set up that server in the first place. Even if they can't prove that she compromised classified data, what sort of Secretary of State could function effectively if they *weren't* getting classified data. My strategy would be to make her look (as of course she is) incompetent.

Their strategy is already clear as well. "What difference, at this point, does it make?"

The GOPE has to give her an out - they knew more about Benghazi then they have told us to-date. Obie in on it also. Another possibility is that Obie is included in some of these emails and he wants them under his control - e.g. Loretta Lynch and James Comey. Obie thought he had this covered with Boner and McConnell but now it looks like it might get out of hand and so he is having Lynch take over. A couple of rouge Inspectors General have upset the apple cart.

If Obama wants to get a different nominee, he could do it next week or next month.

All he has to do is PARDON HRC for anything related to mail servers. If she accepts the pardon, she’s dead politically. If she refuses, he lets her twist in the wind, and maybe lights a fire under the FBI, etc.
