The judge presiding over the prosecution of six Baltimore Police officers involved in the arrest of Freddie Gray struck the state's motion for a gag order in the case. Judge Charles J. Peters ruled the motion lacked standing in an actual proceeding, as it was filed by Baltimore State's Attorney Marilyn Mosby's office in Circuit Court on May 14. At that time, the officers' cases were still in District Court. They weren't transferred to Circuit Court until May 21, when the officers were indicted. Rochelle Ritchie, a Mosby spokeswoman, declined to say whether the state planned to file a new gag order motion, which Peters' ruling did not preclude.

The posted portion of this article absolutely butchers legal terminology. Motions do not generally get “struck”. They get denied. Also, motions do not “lack standing”. Parties lack standing. Motions may be premature, or the court may lack jurisdiction to hear the motion.
This kind of butchery is not surprising, given that the report when the motion was filed was that the Prosecutor filed an “Order”, when it was really a motion asking for an order.
If Prosecutors could file their own orders, that would really get the criminals off the streets fast. Not to mention everyone else.
The Judge basically said “the court system is not ready for this motion yet.”
There is zero “Wow” factor here.

The judge is obviously a racist.
Mosby will play every diversity card to prevent a Nifong situation. Failing that, expect the usual race pimps to instigate riots.
