Police charges in Freddie Gray case are incompetent at best

Any prosecutor interested in the truth and in justice would have used all the tools at her disposal to find them. Ms. Mosby ignored them. She has one of the most experienced homicide prosecutors in the state of Maryland as chief of her homicide unit, but did not ask him to investigate. She had the police report all of one day before filing charges, her mind already made up. And she failed to make use of the grand jury to gather, probe and test the evidence before a group of average citizens.

In fact, Ms. Mosby was so hasty it appears she locked up two completely innocent officers. She charged Freddie Gray’s arresting officers with “false imprisonment” because she said the knife that Gray had on him was legal. In fact, as The Sun reported, the Police Task Force found it to be illegal after all. It was Ms. Mosby who had no probable cause to lock the arresting officers up, an injustice she could have easily avoided by taking her time.

In the long run, Ms. Mosby may be undermining the cause of justice rather than promoting it. She has created an expectation of guilt and conviction. If that does not happen, many will blame the system as unfair or unjust, when it may have been Ms. Mosby's own lack of competence and/or arrogance in bringing charges so quickly.

I don’t know about arrest, but being on parole lowers the standard for a search.

1. Baltimore’s knife laws are shockingly stupid.

2. Criminally charging two cops without checking the law they were alleged to have misapplied is shockingly stupid.

3. If there are valid charges in there, or if there should have been valid charges, weakening the real case by including bogus, politically-motivated charges is shockingly stupid.

In short, these events fit in nicely with Maryland’s liberal traditions.

I had higher hopes for Baltimore PD fighting back. Like, with a massive case of the blue flu or something along those lines. The rest of the PD must not care, however, so they don’t fight back. So be it.

i feel she charged them to settle down the restless natives knowing it wouldn’t fly and will deal with the repercussions later.

You're probably right. Unfortunately because of her hasty actions those cops responsible for Gray's death will probably walk.

I’m not a fan of this State Attorney who charged the 6 cops. Her job is to prosecute with neither pride or passion, and I do not have faith that she intends to.

However, I also believe that the police charged are all guilty to some degree in the death of Freddie Gray. Some just through their inaction and others through their own malfeasance. She didn’t need a grand jury. As much as I think she’s heading into trouble with her attitude, I do believe she’s right that the probable cause to charge the officers is obvious and they have been justly charged.

“Police only have to believe the knife was illegal. The job of determining if it was legal or not rests with a jury.”

I think we’ll learn Grey wasn’t just standing in the alley...he was dealing and the police saw him doing so. He ran and it went from there.

Yes. One of my state's rules for probation or parole is to obey all police commands. If he was told to stop and didn't, he violated the terms of his parole, and was subject to immediate arrest.

Would someone PLEASE explain to me how anyone gets tried for a “capital or otherwise infamous crime” without an indictment from a Grand Jury? No one could answer me in the Zimmerman/Martin case. Could the 5th Amendment be any more clear?
