The charge is carrying a switchblade. It looks like it was filled out that night. If he was carrying a switchblade, it would have been illegal. The prosecutor said the knife was legal. The document says the knife was recovered. So I guess we will find out at trial, if this was a legitimate arrest or not. It is described as a knife in the handwritten portion of this document and charged under switchblade knife in the typed portion of the document.
What are the punishments for illegitimate arrests? That’s a far cry from murder!! What is the reasoning behind the murder charges? Seems to me to be a political move Like when the feds acted like they were imminently going to press civil rights charges against Zimmerman.
but that’s what Grand Juries are for. And I have faith in them.

I’ve known people who were arrested for carrying a knife with too long a blade AFTER they passed the DUI test.
It was not a switchblade. It was a spring assisted blade.
The States’ Attorney stated correctly, that that is a legal knife in Maryland. However, she blatantly omitted the fact that spring assisted knives are illegal in the city of Baltimore.
She has no case for illegal arrest or false imprisonment and she has to know that, or she is completely inept.
I noticed the officer signed the report, but I don’t see any mention as to the time the incident occurred in the body of his statement. I also see where he said he recovered the knife, but he doesn’t report the disposition of the evidence he confiscated. I would think that documenting the chain-of-evidence would be an important factor when filing charges with the court. I’m questioning this based on what was required of us when we wrote incident reports on inmates.
She’ll have a difficult time pressing the issue of unlawful “ arrest”.
