Small traffic fines can lead to big problems for some Californians

Christina Charles acknowledges she broke the law.

Between 2011 and 2012, Charles improperly stopped at a stop sign. She drove with a missing license plate and a taillight out.

Her license was suspended when she couldn’t pay for the tickets and failed to appear in court. Charles also was stopped for driving on the suspended license and without car insurance.

She eventually piled up $6,000 in debt.

Under Hertzberg’s Senate Bill 405, beginning Jan. 1, 2016, and lasting two years, counties could establish their own amnesty programs and accept fines or bail due on or before Jan. 1, 2013, on sliding scale, with specific guidelines adopted by the state’s Judicial Council.

Everyone whose income exceeds 200 percent of the federal poverty level – more than $23,540 for an individual and $48,500 for a family of four – would pay 80 percent of the fine or bail.

The government would accept 50 percent of the penalty for people who exceed 150 percent but make less than 200 percent. Those below 150 percent of the threshold – $17,655 for a single person and $36,375 for a family of four – could pay 20 percent of what they owe.


So what happened to equal protection under the law? You earn more so your traffic fines are more for the same offense?

Protect the illegals and entitlement leeches at all costs. Where possible shift their penalties off on those who actually work and pay taxes.

While the goal is to get as much money as possible, any way possible from the rich vs. poor, keeping the ‘poor’ out of jail is prime because it makes it all the more difficult for them to vote when you do that.

Poor people can’t afford to be stupid about money.

Told that to a young lad one time. He made OK money for a young single person but he never had any extra money because he would pay his bills late and have to pay extra fees - and kept having less money.

Keep your car in good repair, the taxes and insurance paid up and your license up to date. If you get a ticket - take care of it.

I was stopped about 6 years ago for speeding - didn’t do it - and it cost me $450 to fight it but I won.

I live in Los Angeles and parking tickets are now $70 and I recently got a ticket for making a right turn at a red light after fully stopping (which normally is legal), but I did it at 1:30 pm and at this particular light it was illegal to make a right turn between 1pm and 5pm on weekdays. Apparently there was a sign posted to this effect but I didn't see it. The right turn ticket cost $238. And if I had gone to traffic school it would have cost $308.

I was visiting my daughter in CA and was following her in her car. She turned left and the light was yellow but I followed her because I didn’t want to get lost. The camera caught me and she rec’d a ticket. She told them she wasn’t the driver and gave them my address (she couldn’t afford the ticket and figured they would drop it for me since I was visiting). They sent me a ticket for $800.00, I wrote them and said I couldn’t afford it and they can’t take my license because I don’t have a CA one. They sent me another ticket for over $1200.00 which I ignored, haven’t heard from them since.

The traffic cameras have been deactivated because there was a state law suit, if you drive around LA and Orange county now, they are all covered with tarps.

That’s why you haven’t heard from them.

In California, there is a law that traffic enforcement has to enhance safety. The state was hiding all the rear end accidents from the court, they were found out and the stats revealed that the traffic cams caused more accidents.

Good to know that. I’m going back there and was worried they might find me somehow if I tried renting a car. Are they illegal in the whole state?

Caution.

Failure to appear can result in a bench warrant being issued. States honor bench warrants so the next time your ID gets run by ANY state, you can get cuffed and transported to California.

I got a speeding ticket in Texas once. in a school zone none the less. I fought in court and took careful pictures of all the signs in the neighborhood that showed it was a school zone. HA. My particular street on the way to the office was, indeed, in a school zone. However.... I took my case to court and won. I admitted to speeding but that I was unaware it was a school zone. The sign, that designated the school zone, was obscured by trees in springtime because the flowers are the same color of the sign. I presented my evidence with good humor all the while admitting I was indeed driving the speed limit when it wasn’t a school zone. The judge was fair enough and she said “I suspect you knew it was a school zone and were speeding, however, you did prove that the city has not adequately maintained the tree that is blocking the school zone sign.” WHOO HOO. $250 stayed in my pocket.

That being said I have zero sympathy for this ‘poor’ person who got $6000 worth of fines for breaking the law. Driving without a license? Driving without a license plate? Driving without insurance? Are we suppose to feel bad? What a crock. Even if she couldn’t afford the initial fine the courts will allow payments, hard luck discounts, or even an exchange for community service.

I think so, but I would research and call before you go.

I suspect your record was wiped when they lost their case. But I know from friends when similar things happened, you had to write a letter to get your record wiped because of quirks on how the DMV managed the records and the source of the record in the database.

They’ve been doing it in socialist European countries for years. Every once in a while, there’s a story about a millionaire getting a $10k speeding ticket, etc.

In the name of safety? No, just revenue.
