WASHINGTON Sen. Ted Cruz said Monday that the Supreme Court probably made the wrong decision in 1982 when it ruled that public schools must provide free education to children who are in the country illegally.
Theres a strong argument to say that it was [a mistake], Cruz told a conservative radio host in Des Moines during a campaign visit to Iowa.
WHO host Jan Mickelson, an immigration hardliner, peppered Cruz with questions about Plyler v. Doe, a Texas case in which the justices ruled 5-4 that states must provide public education for students in the country illegally. Jim Plyler was the school superintendent in Tyler, and Doe referred to families living and working there when Texas cut funding for students living in the country illegally.
Mickelson argued that states should now defy the court and ignore the precedent, and prodded Cruz to embrace the idea.
The senator, a top student at Harvard Law School and former clerk to Chief Justice William Rehnquist, stepped carefully. But he agreed that the court got it wrong.
Plyler v. Doe as a legal matter is certainly binding Supreme Court precedent, Cruz said. You can have a theoretical argument about the role of the Supreme Court. But I do think there is value in the principle of stare decisis, which is a Latin term for things which are decided. There is value in legal precedent.
That said, he added, the court probably had no constitutional basis for forcing states to educate children in the country illegally.
There is a very strong argument that the 14th Amendment doesnt require that, Cruz said.

How long can the media keep up the myth of those bogus polls showing Ted Cruz as lagging in support?
It’s difficult to say that the SCOTUS was wrong. Back in 1982 the situation was different. Culminating in Amnesty — which wasn’t so hot a topic back then. Most agreed it was appropriate.
What Obama is doing is reach out and into the Latin American countries and giving them a tacit invite, he includes handouts because it will draw the poor and destitute, so he’s seeding the Democratic party for the future.
It’s been blowing up budgets, causing massive tax increases on the communities that can least afford it, and tanking American test scores. That is not to mention giving incentive to a problem that even the most progressive members of society admit is out of control.
There is a very strong argument that the 14th Amendment doesnt require that, Cruz said.

Eh ???
The 14th Amendment doesn’t apply to illegal aliens..
the 14th Amendment doesnt require the government to do or give anything to illegal aliens...
I don’t think those polls are bogus, merely symptomatic of the monumental sliming this guy has withstood.
This is also a great example of Ted Cruz’s refusal to pander; he knows, understands, and adheres to the principals of our Constitutional form of government. He is not afraid to recognize and acknowledge the different branches of the government, their roles, and the limits of their power.
Plus he’s got a great first name!
Go Ted!
Unfortunately for those who would want to say Ted Cruz is wacky for criticizing the court, he won all of his cases he brought to the U S Supreme Court. Nine of them.
He’d be far more useful as a USSC Justice then in the senate or presidency.
The money saved if we didn't give it to illegal invaders could do alot for American citizens in seven months!
Use that money to target business owners that employ illegal invaders and also landlords that rent to illegal invaders. Use that money to pay down our national debt. Use that money to prosecute corrupt politicians. Use that money to fund better services for our disabled military veterans. Use that money to put the Chamber of Amnesty out ouf business!
States need to become far more aggressive about nullifying both federal court decisions and federal laws. States have no obligation to follow the unconstitutional dictates from Washington. None.
Section 4.
The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned. But neither the United States nor any State shall assume or pay any debt or obligation incurred in aid of insurrection or rebellion against the United States, or any claim for the loss or emancipation of any slave; but all such debts, obligations and claims shall be held illegal and void.
Thus, the political caste can, at will, sell you [and your progeny] into a de facto slavery as these debts are secured against your income, which is non-optional.
Outrageous abuse of power, one which the GOP of the day refused to attack. Bob
Who agreed it was appropriate? It was a 5-4 decision that was flat-out lawless.
You could write a whole essay about how this ties in with the School Lunch Program too.
You have got to get and keep people dependent on the Government.
It is how is grows and sustains itself.
"If you don't feed them, they won't come"
Oh Cruz is not wacky. He’s very smart. I agree with you.

Indeed, Ted Cruz has not dissapointed me yet.
