While President Obama has made it clear his administration will appeal District Court Judge Andrew Hanens ruling blocking his executive action on immigration, the presidents immigration plan will likely be on hold for months or longer.
Though no final decision has been made, Obama administration sources told ABC News today that the Department of Justice is unlikely to seek an emergency stay to block the judges order. The reason is simple: While DOJ thinks it will ultimately prevail on the overall appeal, department officials believe they would not succeed in seeking an emergency stay of Judge Hanens ruling.
The judges ruling is likely to remain in place while the case is appealed before the 5th Circuit Court of Appeals and, quite possibly, to the Supreme Court. That process is likely to take six months -- or longer. That means the 5 million undocumented immigrants who had been hoping to apply for DACA (Deferred Action for Childhood Arrivals) to obtain work permits, drivers licenses, and relief from fear of deportation will have to wait.

Why should they bother to appeal? They’ll simply ignore it.
Most likely will go to the SCOTUS. Let us hope that it will take a VERY long time -— long enough to get a real President into the WH and crush this illegal action. Wishful thinking maybe, but we try...

Obama will lose if they take this case on appeal to the Fifth Circuit. They want to delay this case until they can get a case to take up on appeal in a Democrat controlled circuit like the Ninth Circuit in California.
How? The states won’t be processing the illegals.
This case was filed in the 5th circuit....it will stay in the 5th circuit.
Thankfully, the ninth circus will have nothing to say about the issue.
They don’t want to ask for an emergency stay for one reason and one reason alone -— THEY THINK THEY WOULD LOSE!

Judge Napolitano seems to think that Obama has checkmated himself.
This was not an executive order, this was a memo to Jeh Johnson to go ahead and break the law. Johnson may have been willing before but I’m guessing he has no intent of ignoring a federal judge.
Why bother, the Fix is in.
Wouldn’t be surprised if Obama starts the long appeal process, thereby faking the Republicans out of any resolve to stick to their guns on restricting spending in the DHS budget, and then once they’ve caved and given him unrestricted funding, he’ll ignore the court case and do what he damned well pleases implementing his illegal alien amnesty.
He’s ignored a district court order before, related to oil drilling rights. Don’t recall all the details, but I think the case was in New Orleans and nothing happened when he ignored the law and did what he wanted.

Listening to Judge Napolitano on The Kelly File tonight was quite interesting, and reassuring! He insisted that the 5th Circuit will get any appeal, and because it is conservative, they probably would not halt the stay. Also was quite insistent that SCOTUS would not deal with an appeal . And, there is no way it can go to the Ninth Circuit, thank God!
