Obama administration to allow Native American tribes to grow and sell marijuana

The Obama administration will direct attorneys to not prevent Native American tribes on reservations from growing and selling marijuana even in states where pot is illegal, the Los Angeles Times reported on Thursday. Some federal restrictions will still apply. Marijuana can't be sold to minors, grown on public land, fall into the hands of drug cartels, or systemically spread to states where the drug remains illegal.

It's unclear how many tribes will take advantage of the opportunity. Many are opposed to marijuana legalization.

The federal government will continue enforcing prohibition for those tribes, at their request, even in states where pot is legal.

The Justice Department guidance allows Native American tribes to enforce their own marijuana laws, regardless of what state law says. So tribes could set up schemes to grow and sell marijuana in states where it's illegal, or ban marijuana in states, such as Colorado, where it's legal.

The approach continues a longstanding legal tradition in the US, in which the federal government generally maintains more oversight of tribal lands than states — and has the authority to issue these types of regulations.

This has to be satire? Indian reservations aren’t “public (US Government) land”? Then why are U.S. taxpayer dollars being used to maintain them? Without the flood of taxpayer dollars going there, the Indians wouldn’t be living on the reservations.

Not big. They are already growing it, the feds have been turning a blind eye for years. I have a lot of NA friends.

A lot of the elders don’t like drugs but they are ignored (quietly) by the younger Indians. As you no doubt know, Indians have terrible drug problems in general, the worst being alcohol.

I have a friend who works for the feds and deals with Indians. When he goes to what they call a pow-wow, where he will do presentations regarding oil and gas royalty payments, all the liquor stores in the subject county agree to close for 3 days so the Indians will be sober enough to speak with.

The Indian situation is terrible and much too complicated to go into here. There are wonderful people in many ways, and I wish they had better lives. They don’t deserve to live as they do, even though a lot of it is their own fault. They are a spiritually based people and have had their spirits damaged by generations govt “care’>

They are like prisoners of war.

did any of the tribal councils ask for this? Just wondering, because drugs and alcohol are a scourge that most tribal members want to ban.

I suspect it will be used by fake tribal members, i.e. those who like Elizabeth Warren have no connection with tribal life but use a distant bloodline to get benefits. Or it will be used by some “new” tribes, i.e. part Indian people who have been assimilated for 200 years and whose ancestors lost their land before the revolution, but keep one or two quaint customs so have asked for reparations and very lucrative land in eastern states.

Tobacco is different: it is traditional. But even peyote etc is limited to a few tribes that use it in ceremonies. As for casinos: most are in areas where whites gamble, and most help the tribes take over federal functions like police and hospitals. The danger is mob connections, but they probably didn’t “steal” as much as the BIA...

Booze is still the biggest seller on the rez. Some of the young, male “gangbanger” wannabes in the droopy drawers do the happy smoke while they “tag” EVERYTHING IN SIGHT with spray paint. What I find sad is that the preferred drug of choice of the females of child-bearing age is methamphetamine. The illegals bring it in.

In the ancient world, drugs were used in “sorcery”, i.e. to get visions. Lots of stuff written by drug gurus about how to find “god” with drugs, not mentioning which god they might find. And nearly everyone knows about families destroyed by drug or alcohol abuse.

And of course, stoned people won’t notice that some libertarians call Obama “president Goldman Sachs” because he has allowed the banks to steal us blind.

Most Indian reservations are sovereign land via treaties.

We can’t even send law enforcement in there most of the time.
The Tribe has to agree to it.
